44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the definition of eligible central municipality for
77 purposes of the municipal hotel occupancy tax.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 351.001(7), Tax Code, is amended to read
1010 as follows:
1111 (7) "Eligible central municipality" means:
1212 (A) a municipality with a population of more than
1313 140,000 but less than 1.5 million that is located in a county with a
1414 population of one million or more and that has adopted a capital
1515 improvement plan for the construction or expansion of a convention
1616 center facility;
1717 (B) a municipality with a population of 250,000
1818 or more that:
1919 (i) is located wholly or partly on a barrier
2020 island that borders the Gulf of Mexico;
2121 (ii) is located in a county with a
2222 population of 300,000 or more; and
2323 (iii) has adopted a capital improvement
2424 plan to expand an existing convention center facility;
2525 (C) a municipality with a population of 116,000
2626 or more that:
2727 (i) is located in two counties both of which
2828 have a population of 660,000 or more; and
2929 (ii) has adopted a capital improvement plan
3030 for the construction or expansion of a convention center facility;
3131 (D) a municipality with a population of less than
3232 50,000 that contains a general academic teaching institution that
3333 is not a component institution of a university system, as those
3434 terms are defined by Section 61.003, Education Code; [or]
3535 (E) a municipality with a population of 640,000
3636 or more that:
3737 (i) is located on an international border;
3838 and
3939 (ii) has adopted a capital improvement plan
4040 for the construction or expansion of a convention center facility;
4141 (F) a municipality with a population of 75,000 or
4242 more that:
4343 (i) is located wholly in one county with a
4444 population of 575,000 or more that is adjacent to a county with a
4545 population of four million or more; and
4646 (ii) has adopted a capital improvement plan
4747 for the construction or expansion of a convention center facility;
4848 (G) a municipality with a population of less than
4949 75,000 that is located in three counties, at least one of which has
5050 a population of at least four million; or
5151 (H) an eligible barrier island coastal
5252 municipality described by Subdivision 156.2512(c)(1), with a
5353 population of at least 3,000 but not more than 5,000.
5454 SECTION 2. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2017.
