55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to documentation of proof of identification for voting.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 15.001(a), Election Code, is amended to
1010 read as follows:
1111 (a) Each voter registration certificate issued must
1212 contain:
1313 (1) the voter's name in the form indicated by the
1414 voter, subject to applicable requirements prescribed by Section
1515 13.002 and by rule of the secretary of state;
1616 (2) the voter's residence address or, if the residence
1717 has no address, the address at which the voter receives mail and a
1818 concise description of the location of the voter's residence;
1919 (3) the month, day, and year of the voter's birth;
2020 (4) the number of the county election precinct in
2121 which the voter resides;
2222 (5) the voter's effective date of registration if an
2323 initial certificate;
2424 (6) the voter's registration number;
2525 (7) an indication of the period for which the
2626 certificate is issued;
2727 (8) a statement explaining the circumstances under
2828 which the voter will receive a new certificate;
2929 (9) a space for stamping the voter's political party
3030 affiliation;
3131 (10) a statement that voting with the certificate by a
3232 person other than the person in whose name the certificate is issued
3333 is a felony;
3434 (11) a space for the voter's signature;
3535 (12) a statement that the voter must sign the
3636 certificate personally, if able to sign, immediately on receipt;
3737 (13) a space for the voter to correct the information
3838 on the certificate followed by a signature line;
3939 (14) the statement: "If any information on this
4040 certificate changes or is incorrect, correct the information in the
4141 space provided, sign below, and return this certificate to the
4242 voter registrar.";
4343 (15) the registrar's mailing address and telephone
4444 number; [and]
4545 (16) the jurisdictional or distinguishing number for
4646 the following territorial units in which the voter resides, as
4747 determined by the voter registrar:
4848 (A) congressional district;
4949 (B) state senatorial district;
5050 (C) state representative district;
5151 (D) commissioners precinct;
5252 (E) justice precinct;
5353 (F) city election precinct; and
5454 (G) school district election precinct; and
5555 (17) the photograph of the voter to whom the
5656 certificate is issued if a photograph has been obtained under
5757 Section 31.013.
5858 SECTION 2. Subchapter A, Chapter 31, Election Code, is
5959 amended by adding Section 31.013 to read as follows:
6060 Sec. 31.013. PHOTO IDENTIFICATION ACCESS. The secretary of
6161 state shall establish methods to obtain a photograph of each
6262 registered voter for use on the voter's voter registration
6363 certificate. For purposes of this section, the secretary of state
6464 shall enter into agreements with the Department of Public Safety
6565 and may enter into agreements with other state agencies and
6666 governmental entities for assistance with assigning photographs to
6767 the appropriate voter's voter registration certificate.
6868 SECTION 3. Section 63.0101, Election Code, is amended to
6969 read as follows:
7070 Sec. 63.0101. DOCUMENTATION OF PROOF OF
7171 IDENTIFICATION. The following documentation is an acceptable form
7272 of photo identification under this chapter:
7373 (1) a driver's license, election identification
7474 certificate, or personal identification card issued to the person
7575 by the Department of Public Safety that has not expired or that
7676 expired no earlier than 60 days before the date of presentation;
7777 (2) a United States military identification card that
7878 contains the person's photograph that has not expired or that
7979 expired no earlier than 60 days before the date of presentation;
8080 (3) a United States citizenship certificate issued to
8181 the person that contains the person's photograph;
8282 (4) a United States passport issued to the person that
8383 has not expired or that expired no earlier than 60 days before the
8484 date of presentation; [or]
8585 (5) a license to carry a handgun issued to the person
8686 by the Department of Public Safety that has not expired or that
8787 expired no earlier than 60 days before the date of presentation; or
8888 (6) a voter's voter registration certificate
8989 containing the voter's photograph.
9090 SECTION 4. (a) As soon as practicable after the effective
9191 date of this Act, the secretary of state shall establish, subject to
9292 Subsection (b) of this section, the photo identification access
9393 program required by Section 31.013, Election Code, as added by this
9494 Act.
9595 (b) The photo identification access program required by
9696 Section 31.013, Election Code, as added by this Act, must provide
9797 for voter registration certificates to contain photographs for use
9898 beginning with the general election for state and county officers
9999 held in 2018.
100100 SECTION 5. This Act takes effect September 1, 2017.
