9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 253.010, Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Sec. 253.010. REMOVAL FROM REGISTRY. (a) The Health and | |
13 | 13 | Human Services Commission [department] may remove a person from the | |
14 | 14 | employee misconduct registry if, after receiving a written request | |
15 | 15 | from the person, the commission [department] determines that the | |
16 | 16 | person does not meet the requirements for inclusion in the employee | |
17 | 17 | misconduct registry. | |
18 | 18 | (b) The executive commissioner by rule shall adopt a | |
19 | 19 | procedure for the Health and Human Services Commission to remove a | |
20 | 20 | person from the employee misconduct registry if, after receiving a | |
21 | 21 | written request from the person, the commission determines the | |
22 | 22 | person: | |
23 | 23 | (1) does not qualify for removal under Subsection (a); | |
24 | 24 | (2) has been included in the employee misconduct | |
25 | 25 | registry for at least six months; and | |
26 | 26 | (3) no longer poses a risk of committing reportable | |
27 | 27 | conduct. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2017. |
