77 relating to the removal of certain persons from the employee
88 misconduct registry.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 253.010, Health and Safety Code, is
1111 amended to read as follows:
1212 Sec. 253.010. REMOVAL FROM REGISTRY. (a) The Health and
1313 Human Services Commission [department] may remove a person from the
1414 employee misconduct registry if, after receiving a written request
1515 from the person, the commission [department] determines that the
1616 person does not meet the requirements for inclusion in the employee
1717 misconduct registry.
1818 (b) The executive commissioner by rule shall adopt a
1919 procedure for the Health and Human Services Commission to remove a
2020 person from the employee misconduct registry if, after receiving a
2121 written request from the person, the commission determines the
2222 person:
2323 (1) does not qualify for removal under Subsection (a);
2424 (2) has been included in the employee misconduct
2525 registry for at least six months; and
2626 (3) no longer poses a risk of committing reportable
2727 conduct.
2828 SECTION 2. This Act takes effect September 1, 2017.
