No. 3880 A BILL TO BE ENTITLED AN ACT relating to required notice by telecommunications utilities to owners or managers of a multiunit complex before performing work. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 64, Utilities Code, is amended by adding Subchapter F to read as follows: SUBCHAPTER F. SERVICES AT MULTIUNIT COMPLEXES Sec. 64.251. DEFINITIONS. In this subchapter: (1) "Cable service provider" and "video service provider" have the meanings assigned by Section 66.002. (2) "Multiunit complex" has the meaning assigned by Section 92.151, Property Code. (3) "Telecommunications provider" has the meaning assigned by Section 51.002. Sec. 64.252. REQUIREMENTS FOR SERVICES AT MULTIUNIT COMPLEXES. (a) Before a cable service provider, video service provider, or telecommunications provider provides on-site services at a multiunit complex, the provider, or an agent or employee of the provider, must: (1) provide written notice to the owner or manager of the multiunit complex; (2) agree in writing to comply with the rules and regulations of the owner or manager of the complex while on the property; and (3) obtain express written authorization from the owner or manager of the complex to work at a specific portion of the complex. (b) The written notice described by Subsection (a) must include: (1) the full name of the provider, or if a contractor is acting on behalf of the provider, the full name of the contractor providing the services; (2) the full name of each employee of the provider or contractor that will be providing the services, and if applicable, the identification number of each employee; (3) a description of the services to be provided, including the area of the property on which services will be provided and the building and unit number; and (4) the date on which services are to be provided. (c) On request by the provider or an agent or employee of the provider, the manager of the multiunit complex shall provide in writing the manager's rules and regulations relating to the multiunit complex. (d) The provider is liable for damages caused by the negligence of the provider or an agent or employee of the provider. SECTION 2. This Act takes effect September 1, 2017.
