| 8 | 8 | | owners or managers of a multiunit complex before performing work. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 64, Utilities Code, is amended by adding |
|---|
| 11 | 11 | | Subchapter F to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER F. SERVICES AT MULTIUNIT COMPLEXES |
|---|
| 13 | 13 | | Sec. 64.251. DEFINITIONS. In this subchapter: |
|---|
| 14 | 14 | | (1) "Cable service provider" and "video service |
|---|
| 15 | 15 | | provider" have the meanings assigned by Section 66.002. |
|---|
| 16 | 16 | | (2) "Multiunit complex" has the meaning assigned by |
|---|
| 17 | 17 | | Section 92.151, Property Code. |
|---|
| 18 | 18 | | (3) "Telecommunications provider" has the meaning |
|---|
| 19 | 19 | | assigned by Section 51.002. |
|---|
| 20 | 20 | | Sec. 64.252. REQUIREMENTS FOR SERVICES AT MULTIUNIT |
|---|
| 21 | 21 | | COMPLEXES. (a) Before a cable service provider, video service |
|---|
| 22 | 22 | | provider, or telecommunications provider provides on-site services |
|---|
| 23 | 23 | | at a multiunit complex, the provider, or an agent or employee of the |
|---|
| 24 | 24 | | provider, must: |
|---|
| 25 | 25 | | (1) provide written notice to the owner or manager of |
|---|
| 26 | 26 | | the multiunit complex; |
|---|
| 27 | 27 | | (2) agree in writing to comply with the rules and |
|---|
| 28 | 28 | | regulations of the owner or manager of the complex while on the |
|---|
| 29 | 29 | | property; and |
|---|
| 30 | 30 | | (3) obtain express written authorization from the |
|---|
| 31 | 31 | | owner or manager of the complex to work at a specific portion of the |
|---|
| 32 | 32 | | complex. |
|---|
| 33 | 33 | | (b) The written notice described by Subsection (a) must |
|---|
| 34 | 34 | | include: |
|---|
| 35 | 35 | | (1) the full name of the provider, or if a contractor |
|---|
| 36 | 36 | | is acting on behalf of the provider, the full name of the contractor |
|---|
| 37 | 37 | | providing the services; |
|---|
| 38 | 38 | | (2) the full name of each employee of the provider or |
|---|
| 39 | 39 | | contractor that will be providing the services, and if applicable, |
|---|
| 40 | 40 | | the identification number of each employee; |
|---|
| 41 | 41 | | (3) a description of the services to be provided, |
|---|
| 42 | 42 | | including the area of the property on which services will be |
|---|
| 43 | 43 | | provided and the building and unit number; and |
|---|
| 44 | 44 | | (4) the date on which services are to be provided. |
|---|
| 45 | 45 | | (c) On request by the provider or an agent or employee of the |
|---|
| 46 | 46 | | provider, the manager of the multiunit complex shall provide in |
|---|
| 47 | 47 | | writing the manager's rules and regulations relating to the |
|---|
| 48 | 48 | | multiunit complex. |
|---|
| 49 | 49 | | (d) The provider is liable for damages caused by the |
|---|
| 50 | 50 | | negligence of the provider or an agent or employee of the provider. |
|---|
| 51 | 51 | | SECTION 2. This Act takes effect September 1, 2017. |
