6	6	AN ACT
7	7	relating to the residence address of a person for purposes of a
8	8	response to a confirmation notice sent by the voter registrar.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 15.052(b), Election Code, is amended to
11	11	read as follows:
12	12	(b) The official confirmation notice response form must:
13	13	(1) provide spaces for the voter to include all of the
14	14	information that a person must include in an application to
15	15	register to vote under Section 13.002; [and]
16	16	(2) describe the requirements of Section 15.054,
17	17	provide a space for the voter to indicate if the voter is exempt
18	18	from those requirements, and provide a space to indicate the reason
19	19	for an exemption, if any; and
20	20	(3) be postage prepaid and preaddressed for delivery
21	21	to the registrar.
22	22	SECTION 2. Section 15.053(a), Election Code, is amended to
23	23	read as follows:
24	24	(a) Not later than the 30th day after the date a
25	25	confirmation notice is mailed, the voter shall submit to the
26	26	registrar a written, signed response to the notice that confirms
27	27	the voter's current residence. The response must contain:
28	28	(1) all of the information that a person must include
29	29	in an application to register to vote under Section 13.002; and
30	30	(2) evidence that the voter's residence address is
31	31	established in compliance with Section 15.054 or an indication that
32	32	the voter is exempt from those requirements.
33	33	SECTION 3. Subchapter C, Chapter 15, Election Code, is
34	34	amended by adding Section 15.054 to read as follows:
35	35	Sec. 15.054. RESIDENCE FOR PURPOSES OF CONFIRMATION NOTICE
36	36	RESPONSE. (a) For purposes of Section 15.053, a person's residence
37	37	is established at the first residence address, beginning with
38	38	Subdivision (1) and continuing through Subdivision (6), in the
39	39	following list that is applicable to the person:
40	40	(1) the address stated on a driver's license issued to
41	41	the person by the Department of Public Safety that has not expired
42	42	or, if the person has notified the department of a change of address
43	43	under Section 521.054, Transportation Code, the new address
44	44	contained in the notification;
45	45	(2) the address stated on a personal identification
46	46	card issued to the person by the Department of Public Safety that
47	47	has not expired or, if the person has notified the department of a
48	48	change of address under Section 521.054, Transportation Code, the
49	49	new address contained in the notification;
50	50	(3) the address stated on a license to carry a
51	51	concealed handgun issued to the person by the Department of Public
52	52	Safety that has not expired or, if the person has notified the
53	53	department of a change of address under Section 411.181, Government
54	54	Code, the new address contained in the notification;
55	55	(4) an address corresponding to a residence at which
56	56	the person receives mail;
57	57	(5) the address the person claims as a homestead in
58	58	this state; or
59	59	(6) the registration address of a vehicle the person
60	60	owns.
61	61	(b) A person whose residence in this state has no address
62	62	may establish residence under this section by executing an
63	63	affidavit stating that the person's residence in this state has no
64	64	address, providing a concise description of the location of the
65	65	person's residence, and delivering the affidavit to the registrar
66	66	with the person's response to the confirmation notice.
67	67	(c) The address described by Subsection (a)(4) may not be a
68	68	commercial post office box or similar location that does not
69	69	correspond to a residence.
70	70	(d) This section does not apply to:
71	71	(1) a person who is a member of the armed forces of the
72	72	United States or the spouse or a dependent of a member;
73	73	(2) a person enrolled as a full-time student at an
74	74	institution of higher education;
75	75	(3) a person whose address is confidential under
76	76	Subchapter C, Chapter 56, Code of Criminal Procedure;
77	77	(4) a federal judge, state judge, or spouse of a
78	78	federal or state judge whose driver's license includes the street
79	79	address of a courthouse under Section 521.121, Transportation Code;
80	80	or
81	81	(5) a peace officer whose driver's license omits the
82	82	officer's actual residence address under Section 521.1211,
83	83	Transportation Code.
84	84	(e) Subsection (a)(1) does not apply to a person who holds a
85	85	commercial driver's license under Subchapter C, Chapter 522,
86	86	Transportation Code.
87	87	(f) The secretary of state shall adopt rules as necessary to
88	88	implement this section.
89	89	SECTION 4. This Act takes effect September 1, 2017.
