7 | 7 | | relating to voter registration and voter registration information. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 18.061, Election Code, is amended by |
---|
10 | 10 | | amending Subsection (c) and adding Subsections (f), (g), and (h) to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (c) Under procedures prescribed by the secretary of state, |
---|
13 | 13 | | each voter registrar shall provide to the secretary of state on an |
---|
14 | 14 | | expedited basis the information necessary to maintain the |
---|
15 | 15 | | registration list established under Subsection (a). The procedures |
---|
16 | 16 | | shall provide for the electronic submission of the information and |
---|
17 | 17 | | ensure that each voter registrar collects and reports the correct |
---|
18 | 18 | | month, day, and year of birth for each registered voter. |
---|
19 | 19 | | (f) The secretary of state may contract with an entity that |
---|
20 | 20 | | utilizes secure data to verify change of address information for |
---|
21 | 21 | | the purpose of managing the statewide computerized voter |
---|
22 | 22 | | registration list. |
---|
23 | 23 | | (g) The secretary of state may make verified clerical |
---|
24 | 24 | | changes to the statewide computerized voter registration list based |
---|
25 | 25 | | on information received under this subchapter in a manner that |
---|
26 | 26 | | produces the least possible impact on the voters in this state and |
---|
27 | 27 | | fulfills the secretary of state's responsibility to manage the |
---|
28 | 28 | | voter rolls. The secretary of state shall send notice of any |
---|
29 | 29 | | clerical changes to the voter registrar of the counties considered |
---|
30 | 30 | | appropriate by the secretary. |
---|
31 | 31 | | (h) The secretary of state may adopt rules and prescribe |
---|
32 | 32 | | procedures for the implementation of this section. |
---|
33 | 33 | | SECTION 2. Section 18.062, Election Code, is amended by |
---|
34 | 34 | | adding Subsection (c) to read as follows: |
---|
35 | 35 | | (c) For the voter registration purposes of participating in |
---|
36 | 36 | | a system developed under this section, the secretary of state may |
---|
37 | 37 | | disclose voter information, including a voter's date of birth and |
---|
38 | 38 | | the last four digits of a voter's social security number. |
---|
39 | 39 | | SECTION 3. Subchapter C, Chapter 18, Election Code, is |
---|
40 | 40 | | amended by adding Section 18.0681 to read as follows: |
---|
41 | 41 | | Sec. 18.0681. SECRETARY OF STATE AUTHORITY TO ELIMINATE |
---|
42 | 42 | | DUPLICATE REGISTRATION RECORDS. (a) The secretary of state shall |
---|
43 | 43 | | periodically compare the information regarding voters maintained |
---|
44 | 44 | | as part of the statewide computerized voter registration list to |
---|
45 | 45 | | determine whether any voters have more than one voter registration |
---|
46 | 46 | | record on file. If the secretary determines that a voter on the |
---|
47 | 47 | | registration list has more than one registration record on file, |
---|
48 | 48 | | the secretary may merge the registration records and shall send |
---|
49 | 49 | | notice of the determination to the voter registrar of each county in |
---|
50 | 50 | | which the voter is registered to vote. |
---|
51 | 51 | | (b) The secretary of state shall by rule determine what |
---|
52 | 52 | | information identifies a voter with more than one registration |
---|
53 | 53 | | record in order to produce the least possible impact on voters in |
---|
54 | 54 | | this state and fulfill the secretary of state's responsibility to |
---|
55 | 55 | | manage the voter rolls. The rules must require that, at a minimum, |
---|
56 | 56 | | the first name, the last name, any available middle name, and the |
---|
57 | 57 | | date of birth of a voter in each record be identical. |
---|
58 | 58 | | (c) The secretary of state shall adopt rules and prescribe |
---|
59 | 59 | | procedures for the implementation of this section. |
---|
60 | 60 | | SECTION 4. Section 62.0132(g), Government Code, is amended |
---|
61 | 61 | | to read as follows: |
---|
62 | 62 | | (g) The information contained in a completed questionnaire |
---|
63 | 63 | | may be disclosed to: |
---|
64 | 64 | | (1) a judge assigned to hear a cause of action in which |
---|
65 | 65 | | the respondent to the questionnaire is a potential juror; |
---|
66 | 66 | | (2) court personnel; [and] |
---|
67 | 67 | | (3) a litigant and a litigant's attorney in a cause of |
---|
68 | 68 | | action in which the respondent to the questionnaire is a potential |
---|
69 | 69 | | juror; and |
---|
70 | 70 | | (4) the secretary of state in connection with any |
---|
71 | 71 | | matter of voter registration or the administration of elections. |
---|
72 | 72 | | SECTION 5. Section 521.142(a), Transportation Code, is |
---|
73 | 73 | | amended to read as follows: |
---|
74 | 74 | | (a) An application for an original license must state the |
---|
75 | 75 | | applicant's full name and place and date of birth. This information |
---|
76 | 76 | | must be verified by presentation of proof of identity satisfactory |
---|
77 | 77 | | to the department. An applicant who is not a citizen of the United |
---|
78 | 78 | | States must present to the department documentation issued by the |
---|
79 | 79 | | appropriate United States agency that authorizes the applicant to |
---|
80 | 80 | | be in the United States before the applicant may be issued a |
---|
81 | 81 | | driver's license. The department must accept as satisfactory proof |
---|
82 | 82 | | of identity under this subsection an offender identification card |
---|
83 | 83 | | or similar form of identification issued to an inmate by the Texas |
---|
84 | 84 | | Department of Criminal Justice if the applicant also provides |
---|
85 | 85 | | supplemental verifiable records or documents that aid in |
---|
86 | 86 | | establishing identity. For the purposes of this subsection, a |
---|
87 | 87 | | voter registration certificate is not satisfactory proof of |
---|
88 | 88 | | authorization to be in the United States. |
---|
89 | 89 | | SECTION 6. This Act takes effect immediately if it receives |
---|
90 | 90 | | a vote of two-thirds of all the members elected to each house, as |
---|
91 | 91 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
92 | 92 | | Act does not receive the vote necessary for immediate effect, this |
---|
93 | 93 | | Act takes effect September 1, 2017. |
