77 relating to voter registration and voter registration information.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 18.061, Election Code, is amended by
1010 amending Subsection (c) and adding Subsections (f), (g), and (h) to
1111 read as follows:
1212 (c) Under procedures prescribed by the secretary of state,
1313 each voter registrar shall provide to the secretary of state on an
1414 expedited basis the information necessary to maintain the
1515 registration list established under Subsection (a). The procedures
1616 shall provide for the electronic submission of the information and
1717 ensure that each voter registrar collects and reports the correct
1818 month, day, and year of birth for each registered voter.
1919 (f) The secretary of state may contract with an entity that
2020 utilizes secure data to verify change of address information for
2121 the purpose of managing the statewide computerized voter
2222 registration list.
2323 (g) The secretary of state may make verified clerical
2424 changes to the statewide computerized voter registration list based
2525 on information received under this subchapter in a manner that
2626 produces the least possible impact on the voters in this state and
2727 fulfills the secretary of state's responsibility to manage the
2828 voter rolls. The secretary of state shall send notice of any
2929 clerical changes to the voter registrar of the counties considered
3030 appropriate by the secretary.
3131 (h) The secretary of state may adopt rules and prescribe
3232 procedures for the implementation of this section.
3333 SECTION 2. Section 18.062, Election Code, is amended by
3434 adding Subsection (c) to read as follows:
3535 (c) For the voter registration purposes of participating in
3636 a system developed under this section, the secretary of state may
3737 disclose voter information, including a voter's date of birth and
3838 the last four digits of a voter's social security number.
3939 SECTION 3. Subchapter C, Chapter 18, Election Code, is
4040 amended by adding Section 18.0681 to read as follows:
4141 Sec. 18.0681. SECRETARY OF STATE AUTHORITY TO ELIMINATE
4242 DUPLICATE REGISTRATION RECORDS. (a) The secretary of state shall
4343 periodically compare the information regarding voters maintained
4444 as part of the statewide computerized voter registration list to
4545 determine whether any voters have more than one voter registration
4646 record on file. If the secretary determines that a voter on the
4747 registration list has more than one registration record on file,
4848 the secretary may merge the registration records and shall send
4949 notice of the determination to the voter registrar of each county in
5050 which the voter is registered to vote.
5151 (b) The secretary of state shall by rule determine what
5252 information identifies a voter with more than one registration
5353 record in order to produce the least possible impact on voters in
5454 this state and fulfill the secretary of state's responsibility to
5555 manage the voter rolls. The rules must require that, at a minimum,
5656 the first name, the last name, any available middle name, and the
5757 date of birth of a voter in each record be identical.
5858 (c) The secretary of state shall adopt rules and prescribe
5959 procedures for the implementation of this section.
6060 SECTION 4. Section 62.0132(g), Government Code, is amended
6161 to read as follows:
6262 (g) The information contained in a completed questionnaire
6363 may be disclosed to:
6464 (1) a judge assigned to hear a cause of action in which
6565 the respondent to the questionnaire is a potential juror;
6666 (2) court personnel; [and]
6767 (3) a litigant and a litigant's attorney in a cause of
6868 action in which the respondent to the questionnaire is a potential
6969 juror; and
7070 (4) the secretary of state in connection with any
7171 matter of voter registration or the administration of elections.
7272 SECTION 5. Section 521.142(a), Transportation Code, is
7373 amended to read as follows:
7474 (a) An application for an original license must state the
7575 applicant's full name and place and date of birth. This information
7676 must be verified by presentation of proof of identity satisfactory
7777 to the department. An applicant who is not a citizen of the United
7878 States must present to the department documentation issued by the
7979 appropriate United States agency that authorizes the applicant to
8080 be in the United States before the applicant may be issued a
8181 driver's license. The department must accept as satisfactory proof
8282 of identity under this subsection an offender identification card
8383 or similar form of identification issued to an inmate by the Texas
8484 Department of Criminal Justice if the applicant also provides
8585 supplemental verifiable records or documents that aid in
8686 establishing identity. For the purposes of this subsection, a
8787 voter registration certificate is not satisfactory proof of
8888 authorization to be in the United States.
8989 SECTION 6. This Act takes effect immediately if it receives
9090 a vote of two-thirds of all the members elected to each house, as
9191 provided by Section 39, Article III, Texas Constitution. If this
9292 Act does not receive the vote necessary for immediate effect, this
9393 Act takes effect September 1, 2017.
