55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to exemption of certain women from jury service.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 62.106(a), Government Code, is amended
1010 to read as follows:
1111 (a) A person qualified to serve as a petit juror may
1212 establish an exemption from jury service if the person:
1313 (1) is over 70 years of age;
1414 (2) has legal custody of a child younger than 12 years
1515 of age and the person's service on the jury requires leaving the
1616 child without adequate supervision;
1717 (3) is a student of a public or private secondary
1818 school;
1919 (4) is a person enrolled and in actual attendance at an
2020 institution of higher education;
2121 (5) is an officer or an employee of the senate, the
2222 house of representatives, or any department, commission, board,
2323 office, or other agency in the legislative branch of state
2424 government;
2525 (6) is summoned for service in a county with a
2626 population of at least 200,000, unless that county uses a jury plan
2727 under Section 62.011 and the period authorized under Section
2828 62.011(b)(5) exceeds two years, and the person has served as a petit
2929 juror in the county during the 24-month period preceding the date
3030 the person is to appear for jury service;
3131 (7) is the primary caretaker of a person who is unable
3232 to care for himself or herself;
3333 (8) except as provided by Subsection (b), is summoned
3434 for service in a county with a population of at least 250,000 and
3535 the person has served as a petit juror in the county during the
3636 three-year period preceding the date the person is to appear for
3737 jury service; [or]
3838 (9) is a member of the United States military forces
3939 serving on active duty and deployed to a location away from the
4040 person's home station and out of the person's county of residence;
4141 or
4242 (10) is a mother who is breast-feeding her child.
4343 SECTION 2. This Act applies only to a person summoned to
4444 appear for jury service who is required to appear on or after the
4545 effective date of this Act. A person summoned to appear for jury
4646 service who is required to appear before the effective date of this
4747 Act is governed by the law in effect immediately before the
4848 effective date of this Act, and the former law is continued in
4949 effect for that purpose.
5050 SECTION 3. This Act takes effect September 1, 2017.
