| 10 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 10 | | SECTION 1. Section 30.06, Penal Code, is amended by adding |

| 12 | 11 | | Subsection (f) to read as follows: |
|---|
| 13 | 12 | | (f) It is a defense to prosecution under this section that |
|---|
| 14 | 13 | | at the time of the commission of the offense the actor was an active |
|---|
| 15 | 14 | | judicial officer, as defined by Section 411.201, Government Code. |
|---|
| 16 | 15 | | SECTION 2. The change in law made by this Act applies only to |
|---|
| 17 | 16 | | an offense committed on or after the effective date of this Act. An |
|---|
| 18 | 17 | | offense committed before the effective date of this Act is governed |
|---|
| 19 | 18 | | by the law in effect on the date the offense was committed, and the |
|---|
| 20 | 19 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 21 | 20 | | this section, an offense was committed before the effective date of |
|---|
| 22 | 21 | | this Act if any element of the offense occurred before that date. |
|---|
| 23 | 22 | | SECTION 3. This Act takes effect September 1, 2017. |
