| 7 | 7 | | relating to monetary assistance by the Department of Family and |

| 8 | 8 | | Protective Services provided to foster parents and relative or |
|---|
| 9 | 9 | | designated caregivers for day-care services. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 264.124, Family Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (e) to read as follows: |
|---|
| 13 | 13 | | (e) On receipt of the verification required under |
|---|
| 14 | 14 | | Subsection (b), or as provided by Subsection (d), the department |
|---|
| 15 | 15 | | shall provide monetary assistance to a foster parent for day care |
|---|
| 16 | 16 | | for a foster child, regardless of the type of day care chosen by the |
|---|
| 17 | 17 | | foster parent. The department may not deny monetary assistance to |
|---|
| 18 | 18 | | the foster parent based on the number of hours the foster parent |
|---|
| 19 | 19 | | works each week. |

| 20 | 20 | | SECTION 2. Section 264.755, Family Code, is amended by |
|---|
| 21 | 21 | | adding Subsection (f) to read as follows: |
|---|
| 22 | 22 | | (f) On receipt of the verification required under |
|---|
| 23 | 23 | | Subsection (d), or as provided by Subsection (e), the department |
|---|
| 24 | 24 | | shall provide monetary assistance to a relative or designated |
|---|
| 25 | 25 | | caregiver for day care for the child, regardless of the type of day |
|---|
| 26 | 26 | | care chosen by the relative or designated caregiver. The department |
|---|
| 27 | 27 | | may not deny monetary assistance to the relative or designated |
|---|
| 28 | 28 | | caregiver based on the number of hours the relative or designated |
|---|
| 29 | 29 | | caregiver works each week. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2017. |
