55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to monetary assistance by the Department of Family and
88 Protective Services provided to foster parents and relative or
99 designated caregivers for day-care services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 264.124, Family Code, is amended by
1212 adding Subsection (e) to read as follows:
1313 (e) On receipt of the verification required under
1414 Subsection (b), or as provided by Subsection (d), the department
1515 shall provide monetary assistance to a foster parent for day care
1616 for a foster child, regardless of the type of day care chosen by the
1717 foster parent. The department may not deny monetary assistance to
1818 the foster parent based on the number of hours the foster parent
1919 works each week.
2020 SECTION 2. Section 264.755, Family Code, is amended by
2121 adding Subsection (f) to read as follows:
2222 (f) On receipt of the verification required under
2323 Subsection (d), or as provided by Subsection (e), the department
2424 shall provide monetary assistance to a relative or designated
2525 caregiver for day care for the child, regardless of the type of day
2626 care chosen by the relative or designated caregiver. The department
2727 may not deny monetary assistance to the relative or designated
2828 caregiver based on the number of hours the relative or designated
2929 caregiver works each week.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2017.
