55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the career and technology education allotment and the
88 essential knowledge and skills of the career and technology
99 education and technology applications curriculums.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 42.154(a), (b), (c), and (e), Education
1212 Code, are amended to read as follows:
1313 (a) For each full-time equivalent student in average daily
1414 attendance in an approved career and technology education program
1515 or an approved technology applications course in grades nine
1616 through 12 or in career and technology education programs for
1717 students with disabilities in grades seven through 12, a district
1818 is entitled to:
1919 (1) an annual allotment equal to the adjusted basic
2020 allotment multiplied by a weight of 1.35; and
2121 (2) $50, if the student is enrolled in:
2222 (A) two or more advanced career and technology
2323 education courses [classes] for a total of three or more credits;
2424 (B) two or more advanced technology applications
2525 courses for a total of three or more credits; or
2626 (C) [(B)] an advanced course as part of a
2727 tech-prep program under Subchapter T, Chapter 61.
2828 (b) In this section, "full-time equivalent student" means
2929 30 hours of contact a week between a student and career and
3030 technology education program or technology applications personnel.
3131 (c) Funds allocated under this section, other than an
3232 indirect cost allotment established under State Board of Education
3333 rule, must be used in providing career and technology education
3434 programs and technology applications courses in grades nine through
3535 12 or career and technology education programs for students with
3636 disabilities in grades seven through 12 under Sections 29.182,
3737 29.183, and 29.184.
3838 (e) Out of the total statewide allotment [for career and
3939 technology education] under this section, the commissioner shall
4040 set aside an amount specified in the General Appropriations Act,
4141 which may not exceed an amount equal to one percent of the total
4242 amount appropriated, to support regional career and technology
4343 education planning. After deducting the amount set aside under
4444 this subsection from the total amount appropriated for career and
4545 technology education and technology applications under this
4646 section, the commissioner shall reduce each district's tier one
4747 allotments in the same manner described for a reduction in
4848 allotments under Section 42.253.
4949 SECTION 2. Section 42.101(a), Education Code, is amended to
5050 read as follows:
5151 (a) For each student in average daily attendance, not
5252 including the time students spend each day in special education
5353 programs in an instructional arrangement other than mainstream
5454 programs, [or] career and technology education programs, or
5555 technology applications courses, for which an additional allotment
5656 is made under Subchapter C, a district is entitled to an allotment
5757 equal to the lesser of $4,765 or the amount that results from the
5858 following formula:
5959 A = $4,765 X (DCR/MCR)
6060 where:
6161 "A" is the allotment to which a district is entitled;
6262 "DCR" is the district's compressed tax rate, which is the
6363 product of the state compression percentage, as determined under
6464 Section 42.2516, multiplied by the maintenance and operations tax
6565 rate adopted by the district for the 2005 tax year; and
6666 "MCR" is the state maximum compressed tax rate, which is the
6767 product of the state compression percentage, as determined under
6868 Section 42.2516, multiplied by $1.50.
6969 SECTION 3. Not later than March 1, 2019, the State Board of
7070 Education shall:
7171 (1) conduct a review of the essential knowledge and
7272 skills of the career and technology and technology applications
7373 curriculums; and
7474 (2) amend the board's rules in the Texas
7575 Administrative Code to consolidate the technology applications
7676 courses for grades nine through 12 in 19 T.A.C. Chapter 126,
7777 Subchapter C, with the career and technology courses in 19 T.A.C.
7878 Chapter 130, and eliminate duplicative courses while ensuring
7979 certifications are aligned with the rigor of each individual
8080 course.
8181 SECTION 4. This Act applies beginning with the 2017-2018
8282 school year.
8383 SECTION 5. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2017.
