7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Title 10, Chapter 49, Sec. 49.08, Penal code, is | |
9 | 9 | amended to read as follows: | |
10 | 10 | Sec. 49.08. INTOXICATION MANSLAUGHTER. (a) A person | |
11 | 11 | commits an offense if the person: | |
12 | 12 | (1) operates a motor vehicle in a public place, | |
13 | 13 | operates an aircraft, a watercraft, or an amusement ride, or | |
14 | 14 | assembles a mobile amusement ride; and | |
15 | 15 | (2) is intoxicated and by reason of that intoxication | |
16 | 16 | causes the death of another by accident or mistake. | |
17 | 17 | (b) Except as provided by Section 49.09, an offense under 14 | |
18 | 18 | this section is a felony of the first [second] degree. | |
19 | 19 | SECTION 2. This Act takes effect September 1, 2017. |
