| 7 | 7 | | relating to the allocation of certain general revenue to grants for |
|---|
| 8 | 8 | | local guardianship programs and local money management services. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 531.077(b), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) The Medicaid account is an account in the general |
|---|
| 13 | 13 | | revenue fund. Any funds recovered by implementing 42 U.S.C. |
|---|
| 14 | 14 | | Section 1396p(b)(1) shall be deposited in the Medicaid account. |
|---|
| 15 | 15 | | Money in the account may be appropriated only as follows: |
|---|
| 16 | 16 | | (1) the first $750,000 of money appropriated from the |
|---|
| 17 | 17 | | account for a state fiscal year may be appropriated only to provide |
|---|
| 18 | 18 | | grants for the development, expansion, and operation of local |
|---|
| 19 | 19 | | guardianship programs and local money management services, to the |
|---|
| 20 | 20 | | extent not prohibited by federal law; and |
|---|
| 21 | 21 | | (2) the remainder may be appropriated only to fund |
|---|
| 22 | 22 | | long-term care, including community-based care and facility-based |
|---|
| 23 | 23 | | care. |
|---|
| 24 | 24 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 25 | 25 | | appropriations made for a state fiscal year that begins on or after |
|---|
| 26 | 26 | | September 1, 2019. |
|---|
| 27 | 27 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 28 | 28 | | a state agency determines that a waiver or authorization from a |
|---|
| 29 | 29 | | federal agency is necessary for implementation of that provision, |
|---|
| 30 | 30 | | the agency affected by the provision shall request the waiver or |
|---|
| 31 | 31 | | authorization and may delay implementing that provision until the |
|---|
| 32 | 32 | | waiver or authorization is granted. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect September 1, 2017. |
