55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the allocation of certain general revenue to grants for
88 local guardianship programs and local money management services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 531.077(b), Government Code, is amended
1111 to read as follows:
1212 (b) The Medicaid account is an account in the general
1313 revenue fund. Any funds recovered by implementing 42 U.S.C.
1414 Section 1396p(b)(1) shall be deposited in the Medicaid account.
1515 Money in the account may be appropriated only as follows:
1616 (1) the first $750,000 of money appropriated from the
1717 account for a state fiscal year may be appropriated only to provide
1818 grants for the development, expansion, and operation of local
1919 guardianship programs and local money management services, to the
2020 extent not prohibited by federal law; and
2121 (2) the remainder may be appropriated only to fund
2222 long-term care, including community-based care and facility-based
2323 care.
2424 SECTION 2. The changes in law made by this Act apply only to
2525 appropriations made for a state fiscal year that begins on or after
2626 September 1, 2019.
2727 SECTION 3. If before implementing any provision of this Act
2828 a state agency determines that a waiver or authorization from a
2929 federal agency is necessary for implementation of that provision,
3030 the agency affected by the provision shall request the waiver or
3131 authorization and may delay implementing that provision until the
3232 waiver or authorization is granted.
3333 SECTION 4. This Act takes effect September 1, 2017.
