| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter M, Chapter 401, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 401.5095 to read as follows: |
|---|
| 12 | 12 | | Sec. 401.5095. CONTINUING EDUCATION. (a) The commission |
|---|
| 13 | 13 | | by rule shall: |
|---|
| 14 | 14 | | (1) establish a minimum number of hours of continuing |
|---|
| 15 | 15 | | education required for certificate or license renewal under this |
|---|
| 16 | 16 | | subchapter; and |
|---|
| 17 | 17 | | (2) recognize, prepare, or administer a continuing |
|---|
| 18 | 18 | | education program for a person certified or licensed under this |
|---|
| 19 | 19 | | subchapter. |
|---|
| 20 | 20 | | (b) The department may develop and adopt: |
|---|
| 21 | 21 | | (1) a process to evaluate or approve a continuing |
|---|
| 22 | 22 | | education provider or program; and |
|---|
| 23 | 23 | | (2) a process to assess a certificate holder's or |
|---|
| 24 | 24 | | license holder's participation in a continuing education program. |
|---|
| 25 | 25 | | SECTION 2. Not later than August 31, 2017, or as soon as |
|---|
| 26 | 26 | | practicable after the effective date of this Act if more time is |
|---|
| 27 | 27 | | required, the Texas Commission of Licensing and Regulation shall |
|---|
| 28 | 28 | | ensure rules are adopted as required by Section 401.5095, Health |
|---|
| 29 | 29 | | and Safety Code, as added by this Act. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2017. |
|---|
