55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the offenses of sexual assault and
88 aggravated sexual assault.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.011, Penal Code, is amended by
1111 amending Subsection (b) and adding Subsection (e-1) to read as
1212 follows:
1313 (b) A sexual assault under Subsection (a)(1) is without the
1414 consent of the other person if:
1515 (1) the actor compels the other person to submit or
1616 participate by the use of physical force or violence;
1717 (2) the actor compels the other person to submit or
1818 participate by threatening to use force or violence against the
1919 other person, and the other person believes that the actor has the
2020 present ability to execute the threat;
2121 (3) the other person has not consented and the actor
2222 knows the other person is:
2323 (A) unconscious;
2424 (B) [or] physically unable to resist;
2525 (C) incapable of appraising the nature of the
2626 act; or
2727 (D) unaware that the sexual assault is occurring;
2828 (4) the actor knows that as a result of mental disease
2929 or defect the other person is at the time of the sexual assault
3030 incapable either of appraising the nature of the act or of resisting
3131 it;
3232 (5) [the other person has not consented and the actor
3333 knows the other person is unaware that the sexual assault is
3434 occurring;
3535 [(6) the actor has intentionally impaired the other
3636 person's power to appraise or control the other person's conduct by
3737 administering any substance without the other person's knowledge;
3838 [(7)] the actor compels the other person to submit or
3939 participate by threatening to use force or violence against any
4040 person, and the other person believes that the actor has the ability
4141 to execute the threat;
4242 (6) [(8)] the actor is a public servant who coerces
4343 the other person to submit or participate;
4444 (7) [(9)] the actor is a mental health services
4545 provider or a health care services provider who causes the other
4646 person, who is a patient or former patient of the actor, to submit
4747 or participate by exploiting the other person's emotional
4848 dependency on the actor;
4949 (8) [(10)] the actor is a clergyman who causes the
5050 other person to submit or participate by exploiting the other
5151 person's emotional dependency on the clergyman in the clergyman's
5252 professional character as spiritual adviser; [or]
5353 (9) [(11)] the actor is an employee of a facility
5454 where the other person is a resident, unless the employee and
5555 resident are formally or informally married to each other under
5656 Chapter 2, Family Code; or
5757 (10) the actor knows that the other person has
5858 withdrawn consent to the act and the actor persists in the act after
5959 consent is withdrawn.
6060 (e-1) It is not a defense to prosecution under this section
6161 that the actor mistakenly believed that the other person consented
6262 to the conduct if a reasonable person should have known or
6363 understood that the other person did not consent to the conduct.
6464 SECTION 2. Section 22.011(c), Penal Code, is amended by
6565 adding Subdivision (6) to read as follows:
6666 (6) Notwithstanding Section 1.07, "consent" means
6767 express consent demonstrated through words or actions indicating an
6868 active and voluntary agreement to participate in an act.
6969 SECTION 3. Section 22.021, Penal Code, is amended by
7070 amending Subsection (a) and adding Subsection (d-1) to read as
7171 follows:
7272 (a) A person commits an offense:
7373 (1) if the person:
7474 (A) intentionally or knowingly:
7575 (i) causes the penetration of the anus or
7676 sexual organ of another person by any means, without that person's
7777 consent;
7878 (ii) causes the penetration of the mouth of
7979 another person by the sexual organ of the actor, without that
8080 person's consent; or
8181 (iii) causes the sexual organ of another
8282 person, without that person's consent, to contact or penetrate the
8383 mouth, anus, or sexual organ of another person, including the
8484 actor; or
8585 (B) intentionally or knowingly:
8686 (i) causes the penetration of the anus or
8787 sexual organ of a child by any means;
8888 (ii) causes the penetration of the mouth of
8989 a child by the sexual organ of the actor;
9090 (iii) causes the sexual organ of a child to
9191 contact or penetrate the mouth, anus, or sexual organ of another
9292 person, including the actor;
9393 (iv) causes the anus of a child to contact
9494 the mouth, anus, or sexual organ of another person, including the
9595 actor; or
9696 (v) causes the mouth of a child to contact
9797 the anus or sexual organ of another person, including the actor; and
9898 (2) if:
9999 (A) the person:
100100 (i) causes serious bodily injury or
101101 attempts to cause the death of the victim or another person in the
102102 course of the same criminal episode;
103103 (ii) by acts or words places the victim in
104104 fear that any person will become the victim of an offense under
105105 Section 20A.02(a)(3), (4), (7), or (8) or that death, serious
106106 bodily injury, or kidnapping will be imminently inflicted on any
107107 person;
108108 (iii) by acts or words occurring in the
109109 presence of the victim threatens to cause any person to become the
110110 victim of an offense under Section 20A.02(a)(3), (4), (7), or (8) or
111111 to cause the death, serious bodily injury, or kidnapping of any
112112 person;
113113 (iv) uses or exhibits a deadly weapon in the
114114 course of the same criminal episode;
115115 (v) acts in concert with another who
116116 engages in conduct described by Subdivision (1) directed toward the
117117 same victim and occurring during the course of the same criminal
118118 episode; or
119119 (vi) with the intent of facilitating the
120120 commission of the offense, administers or provides [flunitrazepam,
121121 otherwise known as rohypnol, gamma hydroxybutyrate, or ketamine] to
122122 the victim of the offense any substance capable of impairing the
123123 victim's ability to appraise the nature of the act or to resist the
124124 act [with the intent of facilitating the commission of the
125125 offense];
126126 (B) the victim is younger than 14 years of age; or
127127 (C) the victim is an elderly individual or a
128128 disabled individual.
129129 (d-1) It is not a defense to prosecution under this section
130130 that the actor mistakenly believed that the other person consented
131131 to the conduct if a reasonable person should have known or
132132 understood that the other person did not consent to the conduct.
133133 SECTION 4. Section 22.021(b), Penal Code, is amended by
134134 adding Subdivision (4) to read as follows:
135135 (4) Notwithstanding Section 1.07, "consent" has the
136136 meaning assigned by Section 22.011.
137137 SECTION 5. The change in law made by this Act applies only
138138 to an offense committed on or after the effective date of this Act.
139139 An offense committed before the effective date of this Act is
140140 governed by the law in effect on the date the offense was committed,
141141 and the former law is continued in effect for that purpose. For
142142 purposes of this section, an offense was committed before the
143143 effective date of this Act if any element of the offense occurred
144144 before that date.
145145 SECTION 6. This Act takes effect September 1, 2017.
