55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the supervision by a personal bond office of
88 individuals granted an occupational driver's license; providing
99 for an administrative fee.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 521.2462, Transportation Code, is
1212 amended by amending Subsection (a) and adding Subsections (a-1),
1313 (a-2), and (a-3) to read as follows:
1414 (a) The court granting an occupational license under this
1515 subchapter may order the person receiving the license to[:
1616 [(1)] submit to supervision for the purpose of
1717 verifying the person's [by the local community supervision and
1818 corrections department to verify] compliance with the conditions
1919 specified by the order granting the license, including the
2020 conditions specified in accordance with Section 521.248.
2121 (a-1) The court may order the supervision of the person to
2222 be conducted by:
2323 (1) the local community supervision and corrections
2424 department; or
2525 (2) a personal bond office established under Article
2626 17.42, Code of Criminal Procedure.
2727 (a-2) If the court orders the person's supervision to be
2828 conducted by the local community supervision and corrections
2929 department, the court shall order the person to[; and
3030 [(2)] pay a monthly administrative fee under Section
3131 76.015, Government Code.
3232 (a-3) If the court orders the person's supervision to be
3333 conducted by a personal bond office, the office may collect from the
3434 person a reasonable administrative fee of not less than $25 and not
3535 more than $60 per month.
3636 SECTION 2. Section 521.251(d-1), Transportation Code, is
3737 amended to read as follows:
3838 (d-1) Notwithstanding Subsections (b), (c), and (d), the
3939 court may issue an occupational license to a person if the person
4040 submits proof the person has an ignition interlock device installed
4141 on each motor vehicle owned or operated by the person. If a person
4242 issued an occupational license under this subsection fails to
4343 maintain an installed ignition interlock device on each motor
4444 vehicle owned or operated by the person, the court shall revoke the
4545 occupational license under Section 521.252 and reinstate the
4646 suspension of the person's driver's license. A person granted an
4747 occupational license under this subsection may not be ordered,
4848 under Section 521.2462, to submit to the supervision of the local
4949 community supervision and corrections department or a personal bond
5050 office established under Article 17.42, Code of Criminal Procedure
5151 [under Section 521.2462], unless the order is entered by a court of
5252 record.
5353 SECTION 3. Section 76.015, Government Code, is amended by
5454 adding Subsection (a-1) to read as follows:
5555 (a-1) This section does not apply to an individual ordered
5656 to pay an administrative fee to a personal bond office under Section
5757 521.2462(a-3), Transportation Code.
5858 SECTION 4. The change in law made by this Act to Section
5959 521.2462, Transportation Code, applies to an order issued under
6060 that section on or after the effective date of this Act, regardless
6161 of whether the underlying offense giving rise to the order was
6262 committed before, on, or after the effective date of this Act.
6363 SECTION 5. This Act takes effect September 1, 2017.
