| 7 | 7 | | relating to the supervision by a personal bond office of |
|---|
| 8 | 8 | | individuals granted an occupational driver's license; providing |
|---|
| 9 | 9 | | for an administrative fee. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 521.2462, Transportation Code, is |
|---|
| 12 | 12 | | amended by amending Subsection (a) and adding Subsections (a-1), |
|---|
| 13 | 13 | | (a-2), and (a-3) to read as follows: |
|---|
| 14 | 14 | | (a) The court granting an occupational license under this |
|---|
| 15 | 15 | | subchapter may order the person receiving the license to[: |
|---|
| 16 | 16 | | [(1)] submit to supervision for the purpose of |
|---|
| 17 | 17 | | verifying the person's [by the local community supervision and |
|---|
| 18 | 18 | | corrections department to verify] compliance with the conditions |
|---|
| 19 | 19 | | specified by the order granting the license, including the |
|---|
| 20 | 20 | | conditions specified in accordance with Section 521.248. |
|---|
| 21 | 21 | | (a-1) The court may order the supervision of the person to |
|---|
| 22 | 22 | | be conducted by: |
|---|
| 23 | 23 | | (1) the local community supervision and corrections |
|---|
| 24 | 24 | | department; or |
|---|
| 25 | 25 | | (2) a personal bond office established under Article |
|---|
| 26 | 26 | | 17.42, Code of Criminal Procedure. |
|---|
| 27 | 27 | | (a-2) If the court orders the person's supervision to be |
|---|
| 28 | 28 | | conducted by the local community supervision and corrections |
|---|
| 29 | 29 | | department, the court shall order the person to[; and |
|---|
| 30 | 30 | | [(2)] pay a monthly administrative fee under Section |
|---|
| 31 | 31 | | 76.015, Government Code. |
|---|
| 32 | 32 | | (a-3) If the court orders the person's supervision to be |
|---|
| 33 | 33 | | conducted by a personal bond office, the office may collect from the |
|---|
| 34 | 34 | | person a reasonable administrative fee of not less than $25 and not |
|---|
| 35 | 35 | | more than $60 per month. |
|---|
| 36 | 36 | | SECTION 2. Section 521.251(d-1), Transportation Code, is |
|---|
| 37 | 37 | | amended to read as follows: |
|---|
| 38 | 38 | | (d-1) Notwithstanding Subsections (b), (c), and (d), the |
|---|
| 39 | 39 | | court may issue an occupational license to a person if the person |
|---|
| 40 | 40 | | submits proof the person has an ignition interlock device installed |
|---|
| 41 | 41 | | on each motor vehicle owned or operated by the person. If a person |
|---|
| 42 | 42 | | issued an occupational license under this subsection fails to |
|---|
| 43 | 43 | | maintain an installed ignition interlock device on each motor |
|---|
| 44 | 44 | | vehicle owned or operated by the person, the court shall revoke the |
|---|
| 45 | 45 | | occupational license under Section 521.252 and reinstate the |
|---|
| 46 | 46 | | suspension of the person's driver's license. A person granted an |
|---|
| 47 | 47 | | occupational license under this subsection may not be ordered, |
|---|
| 48 | 48 | | under Section 521.2462, to submit to the supervision of the local |
|---|
| 49 | 49 | | community supervision and corrections department or a personal bond |
|---|
| 50 | 50 | | office established under Article 17.42, Code of Criminal Procedure |
|---|
| 51 | 51 | | [under Section 521.2462], unless the order is entered by a court of |
|---|
| 52 | 52 | | record. |
|---|
| 53 | 53 | | SECTION 3. Section 76.015, Government Code, is amended by |
|---|
| 54 | 54 | | adding Subsection (a-1) to read as follows: |
|---|
| 55 | 55 | | (a-1) This section does not apply to an individual ordered |
|---|
| 56 | 56 | | to pay an administrative fee to a personal bond office under Section |
|---|
| 57 | 57 | | 521.2462(a-3), Transportation Code. |
|---|
| 58 | 58 | | SECTION 4. The change in law made by this Act to Section |
|---|
| 59 | 59 | | 521.2462, Transportation Code, applies to an order issued under |
|---|
| 60 | 60 | | that section on or after the effective date of this Act, regardless |
|---|
| 61 | 61 | | of whether the underlying offense giving rise to the order was |
|---|
| 62 | 62 | | committed before, on, or after the effective date of this Act. |
|---|
| 63 | 63 | | SECTION 5. This Act takes effect September 1, 2017. |
