| 10 | 10 | SECTION 1. Subchapter C, Chapter 341, Health and Safety | |
| 11 | 11 | Code, is amended by adding Section 341.0391 to read as follows: | |
| 12 | 12 | Sec. 341.0391. COUNTY PILOT PROGRAM FOR WASTEWATER REUSE. | |
| 13 | 13 | (a) This section applies only to a county with a population of more | |
| 14 | 14 | than 3.3 million. | |
| 15 | 15 | (b) A county may implement a pilot program to reuse any form | |
| 16 | 16 | of wastewater at a county facility for subsurface irrigation and | |
| 17 | 17 | toilet and urinal flushing. The program must require the wastewater | |
| 18 | 18 | to be treated at the facility before reuse. | |
| 19 | 19 | (c) The commission may adopt rules to ensure that a program | |
| 20 | 20 | implemented under this section does not create a nuisance and does | |
| 21 | 21 | not threaten human health or damage the quality of surface water and | |
| 22 | 22 | groundwater in this state. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2017. |
