79 relating to fees imposed by a county for licensing a junkyard or
810 automotive wrecking and salvage yard.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 396.041(c), Transportation Code, is
1113 amended to read as follows:
1214 (c) An ordinance may:
1315 (1) impose a fee for the issuance or renewal of a
1416 license in an amount:
1517 (A) of $25, if the ordinance is adopted by the
1618 commissioners court of a county not described by Paragraph (B),
1719 (C), or (D) [for the issuance or renewal of a license];
1820 (B) [(2) impose a fee] of not more than[:
1921 [(A)] $150 [for the issuance or renewal of a
2022 license], if the ordinance is adopted by the commissioners court of
2123 a county with a population of one million or more that contains two
2224 or more municipalities, each of which has a population of 250,000 or
2325 more; [or]
2426 (C) of not more than [(B)] $500 [for the
2527 issuance or renewal of a license], if the ordinance is adopted by
2628 the commissioners court of a county with a population of 3.3 million
2729 or more; or
2830 (D) necessary to pay for the administration and
2931 enforcement of the ordinance, but not more than $150, if the
3032 ordinance is adopted by the commissioners court of a county located
3133 on the Texas-Mexico border that has a population of less than
3234 300,000 and contains one or more municipalities with a population
3335 of 200,000 or more;
3436 (2) [(3)] condition the license on the operation of
3537 the junkyard or automotive wrecking and salvage yard only at a
3638 location approved by the commissioners court; or
3739 (3) [(4)] establish grounds for suspending or
3840 revoking a license if the junkyard or automotive wrecking and
3941 salvage yard is not screened.
4042 SECTION 2. This Act takes effect September 1, 2017.
