| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Section 396.041(c), Transportation Code, is |
|---|
| 11 | 13 | | amended to read as follows: |
|---|
| 12 | 14 | | (c) An ordinance may: |
|---|
| 13 | 15 | | (1) impose a fee for the issuance or renewal of a |
|---|
| 14 | 16 | | license in an amount: |
|---|
| 15 | 17 | | (A) of $25, if the ordinance is adopted by the |
|---|
| 16 | 18 | | commissioners court of a county not described by Paragraph (B), |
|---|
| 17 | 19 | | (C), or (D) [for the issuance or renewal of a license]; |
|---|
| 18 | 20 | | (B) [(2) impose a fee] of not more than[: |
|---|
| 19 | 21 | | [(A)] $150 [for the issuance or renewal of a |
|---|
| 20 | 22 | | license], if the ordinance is adopted by the commissioners court of |
|---|
| 21 | 23 | | a county with a population of one million or more that contains two |
|---|
| 22 | 24 | | or more municipalities, each of which has a population of 250,000 or |
|---|
| 23 | 25 | | more; [or] |
|---|
| 24 | 26 | | (C) of not more than [(B)] $500 [for the |
|---|
| 25 | 27 | | issuance or renewal of a license], if the ordinance is adopted by |
|---|
| 26 | 28 | | the commissioners court of a county with a population of 3.3 million |
|---|
| 27 | 29 | | or more; or |
|---|
| 28 | 30 | | (D) necessary to pay for the administration and |
|---|
| 29 | 31 | | enforcement of the ordinance, but not more than $150, if the |
|---|
| 30 | 32 | | ordinance is adopted by the commissioners court of a county located |
|---|
| 31 | 33 | | on the Texas-Mexico border that has a population of less than |
|---|
| 32 | 34 | | 300,000 and contains one or more municipalities with a population |
|---|
| 33 | 35 | | of 200,000 or more; |
|---|
| 34 | 36 | | (2) [(3)] condition the license on the operation of |
|---|
| 35 | 37 | | the junkyard or automotive wrecking and salvage yard only at a |
|---|
| 36 | 38 | | location approved by the commissioners court; or |
|---|
| 37 | 39 | | (3) [(4)] establish grounds for suspending or |
|---|
| 38 | 40 | | revoking a license if the junkyard or automotive wrecking and |
|---|
| 39 | 41 | | salvage yard is not screened. |

| 40 | 42 | | SECTION 2. This Act takes effect September 1, 2017. |
