| 8 | 8 | | and permit amendment applications for groundwater conservation |
|---|
| 9 | 9 | | districts. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Section 36.113(c), Water Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (c) A district may require that only the following be |
|---|
| 14 | 14 | | included in the permit or permit amendment application, as |
|---|
| 15 | 15 | | applicable under the rules of the district: |
|---|
| 16 | 16 | | (1) the name and mailing address of the applicant and |
|---|
| 17 | 17 | | the owner of the land on which the well will be located; |
|---|
| 18 | 18 | | (2) if the applicant is other than the owner of the |
|---|
| 19 | 19 | | property, documentation establishing the applicable authority to |
|---|
| 20 | 20 | | construct and operate a well for the proposed use; |
|---|
| 21 | 21 | | (3) a statement of the nature and purpose of the |
|---|
| 22 | 22 | | proposed use and the amount of water to be used for each purpose; |
|---|
| 23 | 23 | | (4) a water conservation plan or a declaration that |
|---|
| 24 | 24 | | the applicant will comply with the district's management plan; |
|---|
| 25 | 25 | | (5) the location of each well and the estimated rate at |
|---|
| 26 | 26 | | which water will be withdrawn; |
|---|
| 27 | 27 | | (6) a water well closure plan or a declaration that the |
|---|
| 28 | 28 | | applicant will comply with well plugging guidelines and report |
|---|
| 29 | 29 | | closure to the commission; [and] |
|---|
| 30 | 30 | | (7) a drought contingency plan; and |
|---|
| 31 | 31 | | (8) other information: |
|---|
| 32 | 32 | | (A) included in a rule of the district in effect |
|---|
| 33 | 33 | | on the date the application is submitted that specifies what |
|---|
| 34 | 34 | | information must be included in an application for a determination |
|---|
| 35 | 35 | | of administrative completeness; and |
|---|
| 36 | 36 | | (B) reasonably related to an issue that a |
|---|
| 37 | 37 | | district is authorized to consider under this chapter. |
|---|
| 38 | 38 | | SECTION 2. Section 36.114(h), Water Code, is amended to |
|---|
| 39 | 39 | | read as follows: |
|---|
| 40 | 40 | | (h) An application is administratively complete if it |
|---|
| 41 | 41 | | contains the [application requires] information set forth under [in |
|---|
| 42 | 42 | | accordance with] Sections 36.113 and 36.1131. A district shall not |
|---|
| 43 | 43 | | require that additional information be included in an application |
|---|
| 44 | 44 | | for a determination of administrative completeness. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2017. |
