| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. AMNESTY PROGRAM. (a) In this section, "offense |
|---|
| 11 | 11 | | relating to the operating of a motor vehicle while intoxicated" has |
|---|
| 12 | 12 | | the meaning assigned by Section 49.09, Penal Code. |
|---|
| 13 | 13 | | (b) Not later than September 1, 2017, the Department of |
|---|
| 14 | 14 | | Public Safety of the State of Texas by rule shall establish an |
|---|
| 15 | 15 | | amnesty program for holders of a driver's license on which a |
|---|
| 16 | 16 | | surcharge has been assessed under Chapter 708, Transportation Code. |
|---|
| 17 | 17 | | (c) Except as otherwise provided by Subsection (e) of this |
|---|
| 18 | 18 | | section, the Department of Public Safety of the State of Texas by |
|---|
| 19 | 19 | | rule shall offer a holder of a driver's license on which a surcharge |
|---|
| 20 | 20 | | has been assessed a 50 percent reduction of the total dollar amount |
|---|
| 21 | 21 | | of unpaid surcharges owed by the license holder for a 30-day period |
|---|
| 22 | 22 | | to be determined by the department. |
|---|
| 23 | 23 | | (d) The Department of Public Safety of the State of Texas |
|---|
| 24 | 24 | | shall, not later than 30 days before the amnesty program goes into |
|---|
| 25 | 25 | | effect, provide written notice to each person eligible to |
|---|
| 26 | 26 | | participate in the amnesty program. |
|---|
| 27 | 27 | | (e) A surcharge may not be reduced under this section if the |
|---|
| 28 | 28 | | surcharge was assessed for: |
|---|
| 29 | 29 | | (1) an offense relating to the operating of a motor |
|---|
| 30 | 30 | | vehicle while intoxicated; or |
|---|
| 31 | 31 | | (2) an offense involving an accident that caused the |
|---|
| 32 | 32 | | death of another person. |
|---|
| 33 | 33 | | SECTION 2. EXPIRATION. This Act expires January 1, 2019. |
|---|
| 34 | 34 | | SECTION 3. EFFECTIVE DATE. This Act takes effect |
|---|
| 35 | 35 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 36 | 36 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 37 | 37 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 38 | 38 | | immediate effect, this Act takes effect September 1, 2017. |
