99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subtitle F, Title 7,
1111 Transportation Code, is amended to read as follows:
1212 SUBTITLE F. COMMERCIAL MOTOR VEHICLES AND PERSONAL VEHICLES USED
1313 FOR COMMERCIAL PURPOSES
1414 SECTION 2. Subtitle F, Title 7, Transportation Code, is
1515 amended by adding Chapter 649 to read as follows:
1616 CHAPTER 649. TRANSPORTATION NETWORK COMPANY DRIVER'S LICENSES
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 649.001. DEFINITIONS. In this chapter:
1919 (1) "Department" means the Texas Department of Motor
2020 Vehicles.
2121 (2) "Digital network" means any online-enabled
2222 application, software, website, or system offered or used by a
2323 transportation network company that enables a prearranged ride with
2424 a transportation network company driver.
2525 (3) "Personal vehicle" means a vehicle that is used by
2626 a transportation network company driver and is:
2727 (A) owned, leased, or otherwise authorized for
2828 use by the driver; and
2929 (B) not a taxicab, limousine, or similar for-hire
3030 vehicle.
3131 (4) "Prearranged ride" means transportation provided
3232 by a transportation network company driver to a transportation
3333 network company rider, beginning at the time a driver accepts a ride
3434 requested by a rider through a digital network controlled by a
3535 transportation network company and ending at the time the last
3636 requesting rider departs from the driver's personal vehicle. The
3737 term does not include:
3838 (A) a shared expense carpool or vanpool
3939 arrangement or service; or
4040 (B) transportation provided using a taxicab,
4141 limousine, or similar for-hire vehicle.
4242 (5) "Transportation network company" means a
4343 corporation, partnership, sole proprietorship, or other entity
4444 operating in this state that uses a digital network to connect a
4545 transportation network company rider to a transportation network
4646 company driver for a prearranged ride. The term does not include an
4747 entity arranging nonemergency medical transportation under a
4848 contract with the state or a managed care organization for
4949 individuals qualifying for Medicaid or Medicare.
5050 (6) "Transportation network company driver" means an
5151 individual who:
5252 (A) receives connections to potential
5353 transportation network company riders and related services from a
5454 transportation network company in exchange for payment of a fee to
5555 the company; and
5656 (B) uses a personal vehicle to offer or provide a
5757 prearranged ride to a transportation network company rider on
5858 connection with the rider through a digital network controlled by
5959 the company in exchange for compensation or payment of a fee.
6060 (7) "Transportation network company rider" means an
6161 individual who uses a transportation network company's digital
6262 network to connect with a transportation network company driver who
6363 provides a prearranged ride to the individual in the driver's
6464 personal vehicle between points chosen by the individual.
6565 SUBCHAPTER B. DEPARTMENT POWERS AND DUTIES
6666 Sec. 649.010. ISSUANCE OF LICENSE. The department shall
6767 issue a license to a person who meets the requirements of this
6868 chapter and rules adopted under this chapter.
6969 Sec. 649.011. REGISTRY. The department by rule shall adopt
7070 procedures to create and maintain a registry of all persons issued a
7171 license under this chapter.
7272 Sec. 649.012. GENERAL POWERS AND DUTIES. The department may
7373 take action as necessary to administer and enforce this chapter.
7474 Sec. 649.013. RULEMAKING. The department shall adopt rules
7575 for licensing transportation network company drivers and other
7676 rules as necessary to implement this chapter.
7777 Sec. 649.014. FEES. The department by rule shall set the
7878 fees imposed under this chapter in an amount sufficient to recover
7979 costs of administering this chapter.
8080 Sec. 649.015. CRIMINAL HISTORY RECORD. The department
8181 shall obtain from the Federal Bureau of Investigation criminal
8282 history record information on each applicant for a license under
8383 this chapter.
8484 SUBCHAPTER C. REGULATION OF TRANSPORTATION NETWORK COMPANY DRIVERS
8585 Sec. 649.021. LICENSE REQUIRED. A person may not act as a
8686 transportation network company driver unless the person holds a
8787 license under this chapter.
8888 Sec. 649.022. LICENSE APPLICATION. (a) The department by
8989 rule shall establish a license application.
9090 (b) The requirements for a license must include that the
9191 applicant:
9292 (1) submit an application in a form prescribed by the
9393 department;
9494 (2) pay the required fee;
9595 (3) disclose any transportation network company whose
9696 digital network the applicant will use to provide a prearranged
9797 ride to a transportation network company rider;
9898 (4) provide evidence of the applicant's personal
9999 financial responsibility for any personal vehicle the applicant
100100 will use to provide a prearranged ride to a transportation network
101101 company rider; and
102102 (5) submit a complete and legible set of the
103103 applicant's fingerprints in a form prescribed by the department.
104104 Sec. 649.023. TERM; RENEWAL. (a) A license issued under
105105 this chapter expires on the first anniversary of the date of
106106 issuance.
107107 (b) A person may renew a license issued under this chapter
108108 if the person:
109109 (1) submits a renewal application in a form prescribed
110110 by the department;
111111 (2) pays a renewal fee; and
112112 (3) satisfies any other requirements for renewal
113113 adopted by the department.
114114 Sec. 649.024. DISPLAY OF LICENSE. The department by rule
115115 shall adopt requirements for the conspicuous display of a
116116 transportation network company driver's license inside the cab of
117117 any personal vehicle operated by a transportation network company
118118 driver to provide prearranged rides to a transportation network
119119 company rider.
120120 Sec. 649.025. DISPLAY OF INSIGNIA ON VEHICLE. The
121121 department by rule shall adopt requirements for the display of
122122 transportation network company insignia on any personal vehicle
123123 operated by a transportation network company driver to provide
124124 prearranged rides to a transportation network company rider.
125125 Sec. 649.026. REPORT OF ACCIDENT. A transportation network
126126 company driver shall report to the department any accident
127127 involving the driver while the driver is logged on to a digital
128128 network not more than one month after the date of the accident.
129129 Sec. 649.027. INSURANCE. A person acting as a
130130 transportation network company driver under this chapter must
131131 possess evidence of financial responsibility in a form approved by
132132 the department as required under:
133133 (1) Chapter 601 of this code; and
134134 (2) Chapter 1954, Insurance Code.
135135 SUBCHAPTER D. ENFORCEMENT
136136 Sec. 649.051. SUSPENSION OR REVOCATION OF LICENSE. The
137137 department may suspend or revoke a license issued under this
138138 chapter for a violation of this chapter or a rule adopted under this
139139 chapter.
140140 Sec. 649.052. CIVIL PENALTY. A person who violates this
141141 chapter or a rule adopted under this chapter is subject to a civil
142142 penalty in an amount set by the department of not more than $1,000
143143 per violation.
144144 SECTION 3. Not later than December 1, 2017, the Texas
145145 Department of Motor Vehicles shall adopt rules necessary to
146146 implement Chapter 649, Transportation Code, as added by this Act.
147147 SECTION 4. This Act takes effect September 1, 2018.
