66 AN ACT
77 relating to the handgun proficiency required to obtain or renew a
88 license to carry a handgun.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.188(a), Government Code, is amended
1111 to read as follows:
1212 (a) The director by rule shall establish minimum standards
1313 for handgun proficiency and shall develop a course to teach handgun
1414 proficiency and examinations to measure handgun proficiency. The
1515 course to teach handgun proficiency is required for each person who
1616 seeks to obtain a license and must contain training sessions
1717 divided into two parts. One part of the course must be classroom
1818 instruction and the other part must be range instruction and an
1919 actual demonstration by the applicant of the applicant's ability to
2020 safely and proficiently use a handgun. An applicant must be able to
2121 demonstrate, at a minimum, the degree of proficiency that is
2222 required to effectively operate a handgun [of .32 caliber or
2323 above]. The department shall distribute the standards, course
2424 requirements, and examinations on request to any qualified handgun
2525 instructor.
2626 SECTION 2. The change in law made by this Act applies only
2727 to an application to obtain or renew a license to carry a handgun
2828 submitted on or after the effective date of this Act. An
2929 application submitted before the effective date of this Act is
3030 governed by the law in effect when the application was submitted,
3131 and the former law is continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2017.
