6 | 6 | | relating to the prohibition of certain municipal requirements |

7 | 7 | | regarding sales of housing units or residential lots. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Sections 214.905(a) and (b), Local Government |
---|
10 | 10 | | Code, are amended to read as follows: |
---|
11 | 11 | | (a) A municipality may not adopt or enforce a requirement in |
---|
12 | 12 | | any form, including through an ordinance or regulation or as a |
---|
13 | 13 | | condition for granting a building permit, that establishes a |
---|
14 | 14 | | maximum sales price for a privately produced housing unit or |
---|
15 | 15 | | residential building lot. |
---|
16 | 16 | | (b) This section does not affect any authority of a |
---|
17 | 17 | | municipality to[: |
---|
18 | 18 | | [(1)] create or implement an incentive, contract |
---|
19 | 19 | | commitment, density bonus, or other voluntary program designed to |
---|
20 | 20 | | increase the supply of moderate or lower-cost housing units[; or |
---|
21 | 21 | | [(2) adopt a requirement applicable to an area served |
---|
22 | 22 | | under the provisions of Chapter 373A, Local Government Code, which |
---|
23 | 23 | | authorizes homestead preservation districts, if such chapter is |
---|
24 | 24 | | created by an act of the legislature]. |
---|
25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
---|
26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 29 | | Act takes effect September 1, 2017. |
