44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the prohibition of certain municipal requirements
77 regarding sales of housing units or residential lots.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 214.905(a) and (b), Local Government
1010 Code, are amended to read as follows:
1111 (a) A municipality may not adopt or enforce a requirement in
1212 any form, including through an ordinance or regulation or as a
1313 condition for granting a building permit, that establishes a
1414 maximum sales price for a privately produced housing unit or
1515 residential building lot.
1616 (b) This section does not affect any authority of a
1717 municipality to[:
1818 [(1)] create or implement an incentive, contract
1919 commitment, density bonus, or other voluntary program designed to
2020 increase the supply of moderate or lower-cost housing units[; or
2121 [(2) adopt a requirement applicable to an area served
2222 under the provisions of Chapter 373A, Local Government Code, which
2323 authorizes homestead preservation districts, if such chapter is
2424 created by an act of the legislature].
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2017.
