| 10 | 10 | SECTION 1. Section 254.041, Election Code, is amended by | |
| 11 | 11 | amending Subsection (b) and adding Subsection (b-1) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (b) Except as provided by Subsections (b-1) and | |
| 14 | 14 | [Subsection] (c), an offense under this section is a Class C | |
| 15 | 15 | misdemeanor. | |
| 16 | 16 | (b-1) A violation of Subsection (a)(1) is a Class B | |
| 17 | 17 | misdemeanor if it is shown on the trial of the offense that the | |
| 18 | 18 | person knowingly failed to file three or more consecutive reports | |
| 19 | 19 | under this chapter on time. | |
| 20 | 20 | SECTION 2. The changes in law made by this Act apply only to | |
| 21 | 21 | a report required to be filed under Chapter 254, Election Code, on | |
| 22 | 22 | or after the effective date of this Act. A report required to be | |
| 23 | 23 | filed before the effective date of this Act is subject to the law in | |
| 24 | 24 | effect at the time the report was filed, and the former law is | |
| 25 | 25 | continued in effect for that purpose. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2017. |
