66 AN ACT
77 relating to municipal reimbursement of compensation paid by the
88 Texas Department of Transportation for the removal of certain signs
99 due to road construction.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 216, Local Government
1212 Code, is amended by adding Section 216.016 to read as follows:
1313 Sec. 216.016. COSTS OF REMOVAL DUE TO ROAD CONSTRUCTION.
1414 (a) If a sign located in a municipality is required to be removed
1515 because of the widening, construction, or reconstruction of a road
1616 by the Texas Department of Transportation and if relocation of the
1717 sign in the municipality would be allowed under department rules
1818 but is restricted or prohibited by charter, ordinance, or a
1919 decision of the municipality, the municipality shall reimburse the
2020 department for any just compensation paid to the owner or lessee of
2121 the sign in a condemnation proceeding.
2222 (b) For purposes of this section, a sign located in the
2323 extraterritorial jurisdiction of a municipality is considered
2424 located in the municipality.
2525 SECTION 2. The change in law made by this Act applies only
2626 to the removal of a sign that occurs on or after the effective date
2727 of this Act.
2828 SECTION 3. This Act takes effect September 1, 2017.
