4	12		AN ACT
5	13		relating to a list of best practice-based programs and
6	14		research-based practices in certain areas for implementation in
7	15		public schools.
8	16		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	17		SECTION 1. Section 161.325, Health and Safety Code, is
10	18		amended by amending Subsections (a), (a-1), (b), and (c) and adding
11	19		Subsection (a-3) to read as follows:
12	20		(a) The department, in coordination with the Texas
13	21		Education Agency and regional education service centers, shall
14	22		provide and annually update a list of recommended best
15	23		practice-based programs and research-based practices in the areas
16	24		specified under Subsection (a-1) for implementation in public
17	25		elementary, junior high, middle, and high schools within the
18	26		general education setting. Each school district may select from
19	27		the list a program or programs appropriate for implementation in
20	28		the district.
21	29		(a-1) The list must include programs and practices in the
22	30		following areas:
23	31		(1) early mental health intervention;
24	32		(2) building skills related to managing emotions,
25	33		establishing and maintaining positive relationships, and
26	34		responsible decision-making [mental health promotion and positive
27	35		youth development];
28	36		(3) substance abuse prevention;
29	37		(4) substance abuse intervention; [and]
30	38		(5) suicide prevention;
31	39		(6) trauma-informed practices;
32	40		(7) positive school climates; and
33	41		(8) positive behavior supports.
34	42		(a-3) For purposes of Subsection (a-1), "school climate"
35	43		means the quality and character of school life, including
36	44		interpersonal relationships, teaching and learning practices, and
37	45		organizational structures, as experienced by students enrolled in
38	46		the school district, parents of those students, and personnel
39	47		employed by the district.
40	48		(b) The suicide prevention programs on the list must include
41	49		components that provide for training counselors, teachers, nurses,
42	50		administrators, and other staff, as well as law enforcement
43	51		officers and social workers who regularly interact with students,
44	52		to:
45	53		(1) recognize students at risk of committing suicide,
46	54		including students who are or may be the victims of or who engage in
47	55		bullying;
48	56		(2) recognize students displaying early warning signs
49	57		and a possible need for early mental health or substance abuse
50	58		intervention, which warning signs may include declining academic
51	59		performance, depression, anxiety, isolation, unexplained changes
52	60		in sleep or eating habits, and destructive behavior toward self and
53	61		others; and
54	62		(3) intervene effectively with students described by
55	63		Subdivision (1) or (2) by providing notice and referral to a parent
56	64		or guardian so appropriate action, such as seeking mental health or
57	65		substance abuse services, may be taken by a parent or guardian.
58	66		(c) In developing the list of best practice-based programs
59	67		and research-based practices, the department and the Texas
60	68		Education Agency shall consider:
61	69		(1) any existing suicide prevention method developed
62	70		by a school district; and
63	71		(2) any Internet or online course or program developed
64	72		in this state or another state that is based on best practices
65	73		recognized by the Substance Abuse and Mental Health Services
66	74		Administration or the Suicide Prevention Resource Center.
67	75		SECTION 2. Section 21.044(c-1), Education Code, is amended
68	76		to read as follows:
69	77		(c-1) Any minimum academic qualifications for a certificate
70	78		specified under Subsection (a) that require a person to possess a
71	79		bachelor's degree must also require that the person receive, as
72	80		part of the training required to obtain that certificate,
73	81		instruction regarding mental health, substance abuse, and youth
74	82		suicide. The instruction required must:
75	83		(1) be provided through a program selected from the
76	84		list of recommended best practice-based programs and
77	85		research-based practices established under Section 161.325, Health
78	86		and Safety Code; and
79	87		(2) include effective strategies for teaching and
80	88		intervening with students with mental or emotional disorders,
81	89		including de-escalation techniques and positive behavioral
82	90		interventions and supports.
83	91		SECTION 3. This Act takes effect immediately if it receives
84	92		a vote of two-thirds of all the members elected to each house, as
85	93		provided by Section 39, Article III, Texas Constitution. If this
86	94		Act does not receive the vote necessary for immediate effect, this
87	95		Act takes effect September 1, 2017.
