| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 361, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 361.0902 to read as follows: |
|---|
| 12 | 12 | | Sec. 361.0902. AUTHORIZATION FOR CONTROL, MANAGEMENT, OR |
|---|
| 13 | 13 | | DISPOSAL OF CERTAIN NONHAZARDOUS, INDUSTRIAL SOLID WASTES; |
|---|
| 14 | 14 | | HEARING. (a) Notwithstanding any other provision of this chapter |
|---|
| 15 | 15 | | relating to permits, the commission by rule may require a |
|---|
| 16 | 16 | | registration that requires prior approval, or other system of prior |
|---|
| 17 | 17 | | approval, for the control, management, or disposal of industrial |
|---|
| 18 | 18 | | solid wastes for which there are minimum federal requirements under |
|---|
| 19 | 19 | | the Resource Conservation and Recovery Act of 1976 (42 U.S |
|---|
| 20 | 20 | | .C. |
|---|
| 21 | 21 | | Section 6901 et seq.). |
|---|
| 22 | 22 | | (b) Public hearings on an application for a registration |
|---|
| 23 | 23 | | that requires prior approval, or other system of prior approval, |
|---|
| 24 | 24 | | required by rules adopted under this section, are not subject to the |
|---|
| 25 | 25 | | procedural requirements of Chapter 2001, Government Code, or |
|---|
| 26 | 26 | | Chapter 5, Water Code. |
|---|
| 27 | 27 | | SECTION 2. Not later than January 1, 2018, the Texas |
|---|
| 28 | 28 | | Commission on Environmental Quality shall adopt rules to implement |
|---|
| 29 | 29 | | Section 361.0902, Health and Safety Code, as added by this Act. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2017. |
