77 relating to the sunset review of navigation districts.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 325, Government Code, is amended by
1010 adding Section 325.026 to read as follows:
1111 Sec. 325.026. NAVIGATION DISTRICTS SUBJECT TO REVIEW. (a)
1212 A navigation district listed in Subsection (b) is subject to a
1313 limited review under this chapter as if it were a state agency.
1414 (b) This section applies to the:
1515 (1) Aransas County Navigation District;
1616 (2) Brownsville Navigation District;
1717 (3) Calhoun Port Authority;
1818 (4) Cedar Bayou Navigation District;
1919 (5) Chambers-Liberty Counties Navigation District;
2020 (6) Cypress Valley Navigation District;
2121 (7) Galveston County Navigation District No. 1;
2222 (8) Jackson County Navigation District;
2323 (9) Jefferson County Navigation District;
2424 (10) Matagorda County Navigation District No. 1;
2525 (11) Orange County Navigation and Port District;
2626 (12) Port Freeport;
2727 (13) Port Isabel San Benito Navigation District;
2828 (14) Port of Bay City Authority;
2929 (15) Port of Beaumont Navigation District;
3030 (16) Port of Corpus Christi Authority;
3131 (17) Port of Harlingen Authority;
3232 (18) Port of Houston Authority of Harris County;
3333 (19) Port of Port Arthur Navigation District;
3434 (20) Refugio County Navigation District;
3535 (21) Sabine Neches Navigation District of Jefferson
3636 County, Texas;
3737 (22) Sabine Pass Port Authority;
3838 (23) San Patricio County Navigation District No. 1;
3939 (24) Victoria County Navigation District;
4040 (25) West Side Calhoun County Navigation District; and
4141 (26) Willacy County Navigation District.
4242 (c) The limited review under this chapter must assess each
4343 navigation district's:
4444 (1) governance;
4545 (2) management;
4646 (3) operating structure; and
4747 (4) compliance with legislative requirements and the
4848 Texas Constitution.
4949 (d) A navigation district shall pay the cost incurred by the
5050 commission in performing the review. The commission shall
5151 determine the cost, and the district shall pay the amount promptly
5252 on receipt of a statement from the commission detailing the cost.
5353 (e) The commission shall establish a schedule for reviewing
5454 navigation districts under this section so that the first review of
5555 each district is completed not later than January 1, 2023.
5656 (f) Each district shall be reviewed every 12th year after
5757 the first review.
5858 (g) A navigation district is abolished on September 1 of the
5959 year in which the district's review is put before the legislature
6060 unless the district is continued by an act of the legislature.
6161 (h) Together with the commission's report on each
6262 navigation district reviewed under this section, the commission
6363 shall include recommendations regarding issues raised by the
6464 abolishment of the district if the district is not continued by an
6565 act of the legislature, including recommendations for legislation
6666 concerning wrapping up the business of the district.
6767 SECTION 2. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2017.
