| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 325, Government Code, is amended by |
|---|
| 10 | 10 | | adding Section 325.026 to read as follows: |
|---|
| 11 | 11 | | Sec. 325.026. NAVIGATION DISTRICTS SUBJECT TO REVIEW. (a) |
|---|
| 12 | 12 | | A navigation district listed in Subsection (b) is subject to a |
|---|
| 13 | 13 | | limited review under this chapter as if it were a state agency. |
|---|
| 14 | 14 | | (b) This section applies to the: |
|---|
| 15 | 15 | | (1) Aransas County Navigation District; |
|---|
| 16 | 16 | | (2) Brownsville Navigation District; |
|---|
| 17 | 17 | | (3) Calhoun Port Authority; |
|---|
| 18 | 18 | | (4) Cedar Bayou Navigation District; |
|---|
| 19 | 19 | | (5) Chambers-Liberty Counties Navigation District; |
|---|
| 20 | 20 | | (6) Cypress Valley Navigation District; |
|---|
| 21 | 21 | | (7) Galveston County Navigation District No. 1; |
|---|
| 22 | 22 | | (8) Jackson County Navigation District; |
|---|
| 23 | 23 | | (9) Jefferson County Navigation District; |
|---|
| 24 | 24 | | (10) Matagorda County Navigation District No. 1; |
|---|
| 25 | 25 | | (11) Orange County Navigation and Port District; |
|---|
| 26 | 26 | | (12) Port Freeport; |

| 42 | 42 | | (c) The limited review under this chapter must assess each |
|---|
| 43 | 43 | | navigation district's: |
|---|
| 44 | 44 | | (1) governance; |
|---|
| 45 | 45 | | (2) management; |
|---|
| 46 | 46 | | (3) operating structure; and |
|---|
| 47 | 47 | | (4) compliance with legislative requirements and the |
|---|
| 48 | 48 | | Texas Constitution. |
|---|
| 49 | 49 | | (d) A navigation district shall pay the cost incurred by the |
|---|
| 50 | 50 | | commission in performing the review. The commission shall |
|---|
| 51 | 51 | | determine the cost, and the district shall pay the amount promptly |
|---|
| 52 | 52 | | on receipt of a statement from the commission detailing the cost. |
|---|
| 53 | 53 | | (e) The commission shall establish a schedule for reviewing |
|---|
| 54 | 54 | | navigation districts under this section so that the first review of |
|---|
| 55 | 55 | | each district is completed not later than January 1, 2023. |
|---|
| 56 | 56 | | (f) Each district shall be reviewed every 12th year after |
|---|
| 57 | 57 | | the first review. |
|---|
| 58 | 58 | | (g) A navigation district is abolished on September 1 of the |
|---|
| 59 | 59 | | year in which the district's review is put before the legislature |
|---|
| 60 | 60 | | unless the district is continued by an act of the legislature. |
|---|
| 61 | 61 | | (h) Together with the commission's report on each |
|---|
| 62 | 62 | | navigation district reviewed under this section, the commission |
|---|
| 63 | 63 | | shall include recommendations regarding issues raised by the |
|---|
| 64 | 64 | | abolishment of the district if the district is not continued by an |
|---|
| 65 | 65 | | act of the legislature, including recommendations for legislation |
|---|
| 66 | 66 | | concerning wrapping up the business of the district. |
|---|
| 67 | 67 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 68 | 68 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 69 | 69 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 70 | 70 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 71 | 71 | | Act takes effect September 1, 2017. |
