88 AN ACT
99 relating to the sale of fireworks on and before the Juneteenth
1010 holiday.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2154.202(g), Occupations Code, is
1313 amended to read as follows:
1414 (g) Except as provided by Subsection (h), a retail fireworks
1515 permit holder may sell fireworks only to the public, and only during
1616 periods:
1717 (1) beginning June 24 and ending at midnight on July 4;
1818 (2) beginning December 20 and ending at midnight on
1919 January 1 of the following year; [and]
2020 (3) beginning May 1 and ending at midnight on May 5 if
2121 the fireworks are sold at a location that is not more than 100 miles
2222 from the Texas-Mexico border and that is in a county in which the
2323 commissioners court of the county has approved the sale of
2424 fireworks during the period; and
2525 (4) beginning June 16 and ending at midnight on June 23
2626 in a county in which the commissioners court of the county has
2727 approved the sale of fireworks during the period.
2828 SECTION 2. Sections 352.051(b) and (d), Local Government
2929 Code, are amended to read as follows:
3030 (b)(1) The Texas A&M Forest Service in the ordinary course
3131 of its activities shall determine whether drought conditions, as
3232 defined under Subsection (a)(2), exist on average in any county
3333 requesting such a determination. The Texas A&M Forest Service
3434 shall make available the measurement index guidelines used to
3535 determine whether drought conditions exist in a particular area.
3636 Following any determination that such drought conditions exist, the
3737 Texas A&M Forest Service shall notify said county or counties when
3838 such drought conditions no longer exist. The Texas A&M Forest
3939 Service shall make its services available each day during the Texas
4040 Independence Day, San Jacinto Day, Memorial Day, Juneteenth, Fourth
4141 of July, and December fireworks seasons to respond to the request of
4242 any county for a determination whether drought conditions exist on
4343 average in the county.
4444 (2) The Texas A&M Forest Service shall be allowed to
4545 take such donations of equipment or funds as necessary to aid in the
4646 carrying out of this section.
4747 (d) To facilitate compliance with an order adopted under
4848 Subsection (c), the order must be adopted before:
4949 (1) February 15 of each year for the Texas
5050 Independence Day fireworks season;
5151 (2) April 1 of each year for the San Jacinto Day
5252 fireworks season;
5353 (3) April 25 of each year for the Cinco de Mayo
5454 fireworks season;
5555 (4) May 15 of each year for the Memorial Day fireworks
5656 season;
5757 (5) June 1 of each year for the Juneteenth fireworks
5858 season;
5959 (6) June 15 of each year for the Fourth of July
6060 fireworks season; and
6161 (7) [(6)] December 15 of each year for each December
6262 fireworks season.
6363 SECTION 3. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2017.
