10- school based on certain performance during the 2015-2016 school
11- year.

127 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
138 SECTION 1. Section 12.115, Education Code, is amended by
149 adding Subsection (c-2) to read as follows:
15- (c-2) For purposes of revocation under Subsection (c)(1),
16- performance for the 2015-2016 school year may not be considered
17- unacceptable if, but for a data error reported by the
18- open-enrollment charter school to the Public Education Information
19- Management System (PEIMS), the school would have received an
20- acceptable rating under the accountability procedures applicable
21- to the school. If the school demonstrates that the school would
22- have received an acceptable rating but for the data error reported
23- by the school, the commissioner shall assign the school the
24- corrected rating. This subsection expires September 1, 2019.
25- SECTION 2. Section 12.115(c-2), Education Code, as added by
26- this Act, stays a proceeding to revoke a charter or accept the
27- surrender of a charter in lieu of revocation pending on the
28- effective date of this Act until the open-enrollment charter school
29- is given an opportunity to demonstrate a data error claim.
30- SECTION 3. This Act takes effect immediately if it receives

11+ for any school year shall not be considered lower than satisfactory
12+ if, but for a data error reported by the charter school to the
13+ Public Education Information Management System, the school would
14+ have received a satisfactory rating either under the standard
15+ accountability system or under the alternative accountability
16+ system. For any school year that an open-enrollment charter school
17+ demonstrates that it would have received a satisfactory rating but
18+ for a data error reported by the charter school to the Public
19+ Education Information Management System, the commissioner shall
20+ change the school’s academic rating accordingly.
21+ SECTION 2: As soon as practicable after the effective date
22+ of this Act, the commissioner of education shall adopt procedures
23+ for the application and implementation of Section 12.115(c-2),
24+ Education Code, as added by this Act.
25+ SECTION 3. Section 12.115 (c-2), Education Code, as added
26+ by this Act, shall apply to all revocations considered or processed
27+ by the commissioner of education after the effective date of this
28+ Act and shall nullify any charter school revocation process or
29+ surrender in lieu of revocation process or agreement that is being
30+ considered or processed by the Commissioner of Education for a
31+ charter school’s performance in the 2013-2014, 2014-2015, or
32+ 2015-2016 school years.
33+ SECTION 4. This Act takes effect immediately if it receives
3134 a vote of two-thirds of all the members elected to each house, as
3235 provided by Section 39, Article III, Texas Constitution. If this
3336 Act does not receive the vote necessary for immediate effect, this
3437 Act takes effect September 1, 2017.
