44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to increased flexibility in the use of the Instructional
77 Materials Allotment
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 31.0211, Education Code, is amended by
1010 amending Subsection (c) to read as follows:
1111 (c) Subject to Subsection (d), funds allotted under this
1212 section may be used to:
1313 (1) purchase:
1414 (A) materials on the list adopted by the
1515 commissioner, as provided by Section 31.0231;
1616 (B) instructional materials, regardless of
1717 whether the instructional materials are on the list adopted under
1818 Section 31.024;
1919 (C) consumable instructional materials,
2020 including workbooks;
2121 (D) instructional materials for use in bilingual
2222 education classes, as provided by Section 31.029;
2323 (E) instructional materials for use in college
2424 preparatory courses under Section 28.014, as provided by Section
2525 31.031;
2626 (F) supplemental instructional materials, as
2727 provided by Section 31.035;
2828 (G) state-developed open-source instructional
2929 materials, as provided by Subchapter B-1;
3030 (H) instructional materials and technological
3131 equipment under any continuing contracts of the district in effect
3232 on September 1, 2011; and
3333 (I) technological equipment necessary to support
3434 the use of materials included on the list adopted by the
3535 commissioner under Section 31.0231 or any instructional materials
3636 purchased with an allotment under this section; and
3737 (2) pay:
3838 (A) for training educational personnel directly
3939 involved in student learning and/or in the appropriate use of
4040 instructional materials and for providing for access to
4141 technological equipment for instructional use; and
4242 (B) the salary and other expenses of an employee
4343 who is directly involved in student learning, staff involved in
4444 addressing the social-emotional health of students or provides
4545 technical support for the use of technological equipment directly
4646 involved in student learning.
4747 SECTION 2. This Act applies beginning with the 2017-2018
4848 school year.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2017.
