8		-	relating to the power of certain counties to enact park use rules;
9		-	affecting the prosecution of a criminal offense.
	7	+	relating to enforcement of rules for county and municipal parks,
	8	+	playgrounds, historical museums, or historic or prehistoric sites;
	9	+	creating a criminal offense.
10	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11		-	SECTION 1. The heading for Section 320.0455, Local
12		-	Government Code, is amended to read as follows:
13		-	Sec. 320.0455. RULES IN CERTAIN COUNTIES [A POPULOUS
14		-	COUNTY];
15		-	PENALTY FOR VIOLATIONS.
16		-	SECTION 2. Section 320.0455(a), Local Government Code, is
17		-	amended to read as follows:
18		-	(a) This section applies to a county with a population of:
19		-	(1) 2.8 million or more; or
20		-	(2) more than 410,000 and less than 455,000.
	11	+	SECTION 1. Chapter 331, Local Government Code, is amended
	12	+	by adding Section 331.0075 to read as follows:
	13	+	Sec. 331.0075. ENFORCEMENT OF RULES; OFFENSE. (a) A person
	14	+	commits an offense if the person violates a rule prescribed under
	15	+	Section 331.007 and approved by the governing body of the
	16	+	municipality or county that maintains the park, playground,
	17	+	historical museum, or historic or prehistoric site. An offense
	18	+	under this subsection is a Class C misdemeanor.
	19	+	(b) Fines collected under Subsection (a) shall be deposited
	20	+	in the general fund of the municipality or county.
	21	+	SECTION 2. The heading to Section 331.007, Local Government
	22	+	Code, is amended to read as follows:
	23	+	Sec. 331.007. PUBLIC USE; RULES.
21	24		SECTION 3. This Act takes effect September 1, 2017.
