77 relating to commercial insurance rates and forms.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2251.003(b), Insurance Code, is amended
1010 to read as follows:
1111 (b) Except as provided by Section 2251.0031, this [This]
1212 subchapter and Subchapters B, C, and D apply to all lines of the
1313 following kinds of insurance written under an insurance policy or
1414 contract issued by an insurer authorized to engage in the business
1515 of insurance in this state:
1616 (1) general liability insurance;
1717 (2) residential and commercial property insurance,
1818 including farm and ranch insurance and farm and ranch owners
1919 insurance;
2020 (3) personal and commercial casualty insurance,
2121 except as provided by Section 2251.004;
2222 (4) medical professional liability insurance;
2323 (5) fidelity, guaranty, and surety bonds other than
2424 criminal court appearance bonds;
2525 (6) personal umbrella insurance;
2626 (7) personal liability insurance;
2727 (8) guaranteed auto protection (GAP) insurance;
2828 (9) involuntary unemployment insurance;
2929 (10) financial guaranty insurance;
3030 (11) inland marine insurance;
3131 (12) rain insurance;
3232 (13) hail insurance on farm crops;
3333 (14) personal and commercial automobile insurance;
3434 (15) multi-peril insurance; and
3535 (16) identity theft insurance issued under Chapter
3636 706.
3737 SECTION 2. Subchapter A, Chapter 2251, Insurance Code, is
3838 amended by adding Section 2251.0031 to read as follows:
3939 Sec. 2251.0031. EXCEPTIONS FOR CERTAIN LINES. (a) Except
4040 as provided by Subsection (c), Subchapter C does not apply to any
4141 line of the following kinds of insurance written under an insurance
4242 policy or contract issued by an insurer authorized to engage in the
4343 business of insurance in this state:
4444 (1) aircraft liability and hull;
4545 (2) surety bonds;
4646 (3) fidelity bonds;
4747 (4) commercial inland marine;
4848 (5) boiler and machinery;
4949 (6) environmental impairment or pollution liability;
5050 (7) kidnap and ransom;
5151 (8) political risk or expropriation;
5252 (9) commercial excess liability or umbrella
5353 liability;
5454 (10) directors' and officers' liability;
5555 (11) fiduciary liability;
5656 (12) employment practices liability;
5757 (13) errors and omission and professional liability
5858 other than medical malpractice;
5959 (14) media liability;
6060 (15) product liability, product recall, or completed
6161 operations;
6262 (16) cybersecurity, including first and third party
6363 commercial lines coverage for losses arising out of or relating to
6464 data privacy breaches, network security, computer viruses, and
6565 similar exposures;
6666 (17) highly protected commercial property; or
6767 (18) commercial flood insurance not provided through
6868 the National Flood Insurance Program.
6969 (b) The commissioner by rule may exempt a commercial line of
7070 insurance or commercial risk not listed in Subsection (a) from the
7171 rate filing requirements of Subchapter C to promote enhanced
7272 competition or more effectively use the resources of the department
7373 that might otherwise be used to review commercial lines filings.
7474 (c) Notwithstanding Subsection (a), the commissioner may
7575 require rate filings under Subchapter C for a specific kind of
7676 insurance listed in Subsection (a) for a period of not longer than
7777 one year if, after notice and hearing, the commissioner issues an
7878 order that:
7979 (1) includes a finding that a reasonable degree of
8080 competition does not exist for that specific kind of insurance; and
8181 (2) specifies the relevant tests and test results used
8282 to determine the degree of competition for that kind of insurance.
8383 (d) In the absence of a finding described by Subsection (c)
8484 with respect to a specific kind of insurance, a competitive market
8585 is presumed to exist for that kind of insurance.
8686 SECTION 3. Section 2251.004, Insurance Code, is amended to
8787 read as follows:
8888 Sec. 2251.004. REGULATION OF INLAND MARINE RATES. The
8989 commissioner shall adopt rules governing the manner in which rates
9090 for the various classifications of risks insured under personal
9191 lines inland marine insurance, as determined by the commissioner,
9292 are regulated.
9393 SECTION 4. Section 2301.003(b), Insurance Code, is amended
9494 to read as follows:
9595 (b) Except as provided by Section 2301.0031, this [This]
9696 subchapter applies to all lines of the following kinds of insurance
9797 written under an insurance policy or contract issued by an insurer
9898 authorized to engage in the business of insurance in this state:
9999 (1) general liability insurance;
100100 (2) residential and commercial property insurance,
101101 including farm and ranch insurance and farm and ranch owners
102102 insurance;
103103 (3) personal and commercial casualty insurance,
104104 except as provided by Section 2301.005;
105105 (4) medical professional liability insurance;
106106 (5) fidelity, guaranty, and surety bonds other than
107107 criminal court appearance bonds;
108108 (6) personal umbrella insurance;
109109 (7) personal liability insurance;

120120 SECTION 5. Subchapter A, Chapter 2301, Insurance Code, is
121121 amended by adding Section 2301.0031 to read as follows:
122122 Sec. 2301.0031. EXCEPTIONS FOR CERTAIN LINES. (a) Except
123123 as provided by Subsection (c), Sections 2301.006, 2301.007(a) and
124124 (b), and 2301.008 do not apply to any line of the following kinds of
125125 insurance written under an insurance policy or contract issued by
126126 an insurer authorized to engage in the business of insurance in this
127127 state:
128128 (1) aircraft liability and hull;
129129 (2) surety bonds;
130130 (3) fidelity bonds;
131131 (4) commercial inland marine;
132132 (5) boiler and machinery;
133133 (6) environmental impairment or pollution liability;
134134 (7) kidnap and ransom;
135135 (8) political risk or expropriation;
136136 (9) commercial excess liability or umbrella
137137 liability;

160160 insurance listed in Subsection (a) for a period of not longer than

162162 order that:

168168 with respect to a specific kind of insurance, a competitive market
169169 is presumed to exist for that kind of insurance.
170170 SECTION 6. Section 2301.005, Insurance Code, is amended to
171171 read as follows:
172172 Sec. 2301.005. REGULATION OF INLAND MARINE FORMS. The
173173 commissioner shall adopt rules governing the manner in which forms
174174 for the various classifications of risks insured under personal
175175 lines inland marine insurance, as determined by the commissioner,
176176 are regulated.
177177 SECTION 7. The changes in law made by this Act apply only to
178178 an insurance policy that is delivered, issued for delivery, or
179179 renewed on or after January 1, 2018. An insurance policy
180180 delivered, issued for delivery, or renewed before January 1, 2018,
181181 is governed by the law as it existed immediately before the
182182 effective date of this Act, and that law is continued in effect for
183183 that purpose.
184184 SECTION 8. This Act takes effect September 1, 2017.
