66 AN ACT
77 relating to the renewal of a plumber's apprentice certificate of
88 registration.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 1301, Occupations Code, is
1111 amended by adding Section 1301.4055 to read as follows:
1212 Sec. 1301.4055. MANDATORY TRAINING FOR PLUMBER'S
1313 APPRENTICE. (a) To renew the certificate of registration for the
1414 third renewal and any subsequent renewals, a person who holds a
1515 certificate of registration under this chapter as a plumber's
1616 apprentice must complete during the year preceding the renewal date
1717 at least six hours of approved classroom training that includes
1818 training in:
1919 (1) this chapter and board rules;
2020 (2) board-approved plumbing codes; and
2121 (3) health protection, energy conservation, and water
2222 conservation.
2323 (b) A person may receive credit for participating in a
2424 training program only if the program is provided:
2525 (1) by a person approved by the board; and
2626 (2) according to criteria adopted by the board.
2727 (c) A plumber's apprentice who is enrolled and in good
2828 standing in a training program approved by the United States
2929 Department of Labor, Office of Apprenticeship, is exempt from
3030 Subsections (a) and (b).
3131 (d) The board by rule may exempt certain persons from the
3232 requirements of this section if the board determines that the
3333 exemption is in the public interest.
3434 SECTION 2. Section 1301.4055, Occupations Code, as added by
3535 this Act, applies only to the renewal of a certificate of
3636 registration as a plumber's apprentice that expires on or after the
3737 effective date of this Act. A certificate of registration that
3838 expired before the effective date of this Act is governed by the law
3939 in effect on the date the certificate of registration expired, and
4040 the former law is continued in effect for that purpose.
4141 SECTION 3. As soon as practicable after the effective date
4242 of this Act, the Texas State Board of Plumbing Examiners shall adopt
4343 rules necessary to implement Section 1301.4055, Occupations Code,
4444 as added by this Act.
4545 SECTION 4. This Act takes effect September 1, 2017.
