| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 1301, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Section 1301.4055 to read as follows: |
|---|
| 12 | 12 | | Sec. 1301.4055. MANDATORY TRAINING FOR PLUMBER'S |
|---|
| 13 | 13 | | APPRENTICE. (a) To renew the certificate of registration for the |
|---|
| 14 | 14 | | third renewal and any subsequent renewals, a person who holds a |
|---|
| 15 | 15 | | certificate of registration under this chapter as a plumber's |
|---|
| 16 | 16 | | apprentice must complete during the year preceding the renewal date |
|---|
| 17 | 17 | | at least six hours of approved classroom training that includes |
|---|
| 18 | 18 | | training in: |
|---|
| 19 | 19 | | (1) this chapter and board rules; |
|---|
| 20 | 20 | | (2) board-approved plumbing codes; and |
|---|
| 21 | 21 | | (3) health protection, energy conservation, and water |
|---|
| 22 | 22 | | conservation. |
|---|
| 23 | 23 | | (b) A person may receive credit for participating in a |
|---|
| 24 | 24 | | training program only if the program is provided: |
|---|
| 25 | 25 | | (1) by a person approved by the board; and |
|---|
| 26 | 26 | | (2) according to criteria adopted by the board. |
|---|
| 27 | 27 | | (c) A plumber's apprentice who is enrolled and in good |
|---|
| 28 | 28 | | standing in a training program approved by the United States |
|---|
| 29 | 29 | | Department of Labor, Office of Apprenticeship, is exempt from |
|---|
| 30 | 30 | | Subsections (a) and (b). |
|---|
| 31 | 31 | | (d) The board by rule may exempt certain persons from the |
|---|
| 32 | 32 | | requirements of this section if the board determines that the |
|---|
| 33 | 33 | | exemption is in the public interest. |
|---|
| 34 | 34 | | SECTION 2. Section 1301.4055, Occupations Code, as added by |
|---|
| 35 | 35 | | this Act, applies only to the renewal of a certificate of |
|---|
| 36 | 36 | | registration as a plumber's apprentice that expires on or after the |
|---|
| 37 | 37 | | effective date of this Act. A certificate of registration that |
|---|
| 38 | 38 | | expired before the effective date of this Act is governed by the law |
|---|
| 39 | 39 | | in effect on the date the certificate of registration expired, and |
|---|
| 40 | 40 | | the former law is continued in effect for that purpose. |
|---|
| 41 | 41 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 42 | 42 | | of this Act, the Texas State Board of Plumbing Examiners shall adopt |
|---|
| 43 | 43 | | rules necessary to implement Section 1301.4055, Occupations Code, |
|---|
| 44 | 44 | | as added by this Act. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2017. |
|---|
