410 AN ACT
511 relating to the issuance of permits for the movement of oversize and
612 overweight vehicles in certain counties; authorizing an increase in
713 the amount of a fee.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 623.210, Transportation Code, is amended
1016 to read as follows:
1117 Sec. 623.210. OPTIONAL PROCEDURE. This subchapter
1218 provides an optional procedure for the issuance of a permit for the
1319 movement of oversize or overweight vehicles carrying cargo on state
1420 highways located in counties:
1521 (1) contiguous to the Gulf of Mexico or a bay or inlet
1622 opening into the gulf and:
1723 (A) [(1)] adjacent to at least two counties with
1824 a population of 550,000 or more; or
1925 (B) [(2)] bordering the United Mexican States;
2026 or
2127 (2) contiguous to the Gulf of Mexico or a bay or inlet
2228 opening into the gulf with a population of not more than 200,000 and
2329 adjacent to a county described by Subdivision (1)(A).
2430 SECTION 2. Section 623.212, Transportation Code, is amended
2531 to read as follows:
2632 Sec. 623.212. PERMITS BY PORT AUTHORITY. The commission
2733 may authorize a port authority to issue permits for the movement of
2834 oversize or overweight vehicles carrying cargo on state highways
2935 located in counties:
3036 (1) contiguous to the Gulf of Mexico or a bay or inlet
3137 opening into the gulf and:
3238 (A) [(1)] adjacent to at least two counties with
3339 a population of 550,000 or more; or
3440 (B) [(2)] bordering the United Mexican States;
3541 or
3642 (2) contiguous to the Gulf of Mexico or a bay or inlet
3743 opening into the gulf with a population of not more than 200,000 and
3844 adjacent to a county described by Subdivision (1)(A).
3945 SECTION 3. Section 623.214(a), Transportation Code, is
4046 amended to read as follows:
4147 (a) A port authority may collect a fee for permits issued
4248 under this subchapter. Such fees shall not exceed $120 [$80] per
4349 trip.
4450 SECTION 4. Section 623.219(b), Transportation Code, is
4551 amended to read as follows:
4652 (b) For a permit issued by a port authority located in a
4753 county that is adjacent to at least two counties with a population
4854 of 550,000 or more, the commission shall, with the consent of the
4955 port authority, designate the most direct route from:
5056 (1) the intersection of Farm-to-Market Road 523 and
5157 Moller Road to the entrance of Port Freeport using Farm-to-Market
5258 Roads 523 and 1495;
5359 (2) the intersection of State Highway 288 and Chlorine
5460 Road to the entrance of Port Freeport using State Highway 288;
5561 (3) the intersection of State Highway 288 and Chlorine
5662 Road to the entrance of Port Freeport using State Highways 288 and
5763 332 and Farm-to-Market Roads 523 and 1495;
5864 (4) the intersection of North Velasco Boulevard and
5965 South Avenue J in the city of Freeport to the entrance of Port
6066 Freeport using North Velasco Boulevard and Farm-to-Market Road
6167 1495; [and]
6268 (5) 21441 Loop 419 in the city of Sweeny to the
6369 entrance of Port Freeport using Loop 419, State Highways 35 and 36,
6470 and Farm-to-Market Road 1495; and
6571 (6) 5261 Seventh Street in Bay City to the entrance of
6672 Port Freeport using State Highway 35, Loop 419, State Highway 36,
6773 and Farm-to-Market Road 1495.
6874 SECTION 5. This Act takes effect September 1, 2017.
