4	10		AN ACT
5	11		relating to the issuance of permits for the movement of oversize and
6	12		overweight vehicles in certain counties; authorizing an increase in
7	13		the amount of a fee.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. Section 623.210, Transportation Code, is amended
10	16		to read as follows:
11	17		Sec. 623.210. OPTIONAL PROCEDURE. This subchapter
12	18		provides an optional procedure for the issuance of a permit for the
13	19		movement of oversize or overweight vehicles carrying cargo on state
14	20		highways located in counties:
15	21		(1) contiguous to the Gulf of Mexico or a bay or inlet
16	22		opening into the gulf and:
17	23		(A) [(1)] adjacent to at least two counties with
18	24		a population of 550,000 or more; or
19	25		(B) [(2)] bordering the United Mexican States;
20	26		or
21	27		(2) contiguous to the Gulf of Mexico or a bay or inlet
22	28		opening into the gulf with a population of not more than 200,000 and
23	29		adjacent to a county described by Subdivision (1)(A).
24	30		SECTION 2. Section 623.212, Transportation Code, is amended
25	31		to read as follows:
26	32		Sec. 623.212. PERMITS BY PORT AUTHORITY. The commission
27	33		may authorize a port authority to issue permits for the movement of
28	34		oversize or overweight vehicles carrying cargo on state highways
29	35		located in counties:
30	36		(1) contiguous to the Gulf of Mexico or a bay or inlet
31	37		opening into the gulf and:
32	38		(A) [(1)] adjacent to at least two counties with
33	39		a population of 550,000 or more; or
34	40		(B) [(2)] bordering the United Mexican States;
35	41		or
36	42		(2) contiguous to the Gulf of Mexico or a bay or inlet
37	43		opening into the gulf with a population of not more than 200,000 and
38	44		adjacent to a county described by Subdivision (1)(A).
39	45		SECTION 3. Section 623.214(a), Transportation Code, is
40	46		amended to read as follows:
41	47		(a) A port authority may collect a fee for permits issued
42	48		under this subchapter. Such fees shall not exceed $120 [$80] per
43	49		trip.
44	50		SECTION 4. Section 623.219(b), Transportation Code, is
45	51		amended to read as follows:
46	52		(b) For a permit issued by a port authority located in a
47	53		county that is adjacent to at least two counties with a population
48	54		of 550,000 or more, the commission shall, with the consent of the
49	55		port authority, designate the most direct route from:
50	56		(1) the intersection of Farm-to-Market Road 523 and
51	57		Moller Road to the entrance of Port Freeport using Farm-to-Market
52	58		Roads 523 and 1495;
53	59		(2) the intersection of State Highway 288 and Chlorine
54	60		Road to the entrance of Port Freeport using State Highway 288;
55	61		(3) the intersection of State Highway 288 and Chlorine
56	62		Road to the entrance of Port Freeport using State Highways 288 and
57	63		332 and Farm-to-Market Roads 523 and 1495;
58	64		(4) the intersection of North Velasco Boulevard and
59	65		South Avenue J in the city of Freeport to the entrance of Port
60	66		Freeport using North Velasco Boulevard and Farm-to-Market Road
61	67		1495; [and]
62	68		(5) 21441 Loop 419 in the city of Sweeny to the
63	69		entrance of Port Freeport using Loop 419, State Highways 35 and 36,
64	70		and Farm-to-Market Road 1495; and
65	71		(6) 5261 Seventh Street in Bay City to the entrance of
66	72		Port Freeport using State Highway 35, Loop 419, State Highway 36,
67	73		and Farm-to-Market Road 1495.
68	74		SECTION 5. This Act takes effect September 1, 2017.
