55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the limitation on the right of a child's grandparent to
88 request possession of or access to the child.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 153.434, Family Code, is amended to read
1111 as follows:
1212 Sec. 153.434. LIMITATION ON RIGHT TO REQUEST POSSESSION OR
1313 ACCESS. A biological or adoptive grandparent may not request
1414 possession of or access to a grandchild if:
1515 (1) each of the biological parents of the grandchild
1616 has:
1717 (A) died;
1818 (B) had the person's parental rights terminated;
1919 or
2020 (C) executed an affidavit of waiver of interest
2121 in child or an affidavit of relinquishment of parental rights under
2222 Chapter 161 and the affidavit designates the Department of Family
2323 and Protective Services, a licensed child-placing agency, or a
2424 person other than the child's stepparent as the managing
2525 conservator of the child; and
2626 (2) the grandchild has been adopted, or is the subject
2727 of a pending suit for adoption, by a person other than:
2828 (A) the child's stepparent; or
2929 (B) a relative of the grandparent related within
3030 the third degree by consanguinity.
3131 SECTION 2. The change in law made by this Act applies only
3232 to a suit affecting the parent-child relationship filed on or after
3333 the effective date of this Act. A suit filed before that date is
3434 governed by the law in effect on the date the suit was filed, and the
3535 former law is continued in effect for that purpose.
3636 SECTION 3. This Act takes effect September 1, 2017.
