| 6 | 13 | | for air quality permits. |

| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. Section 382.055, Health and Safety Code, is |
|---|
| 9 | 16 | | amended by amending Subsections (c) and (h) and adding Subsection |
|---|
| 10 | 17 | | (c-1) to read as follows: |
|---|
| 11 | 18 | | (c) Not less than 180 days before the date on which the |
|---|
| 12 | 19 | | renewal application is due, the commission shall provide written |
|---|
| 13 | 20 | | notice to the permit holder, by registered or certified mail or as |
|---|
| 14 | 21 | | provided by Subsection (c-1), that the permit is scheduled for |
|---|
| 15 | 22 | | review in accordance with this section. The notice must include a |
|---|
| 16 | 23 | | description of the procedure for filing a renewal application and |
|---|
| 17 | 24 | | the information to be included in the application. |
|---|
| 18 | 25 | | (c-1) A notice under Subsection (c) may be sent by |
|---|
| 19 | 26 | | electronic communication if the commission develops a system that |
|---|
| 20 | 27 | | reliably replaces registered or certified mail as a means of |
|---|
| 21 | 28 | | verifying receipt of the notice. |
|---|
| 22 | 29 | | (h) If the holder of a preconstruction permit to whom the |
|---|
| 23 | 30 | | commission has mailed or otherwise sent notice under this section |
|---|
| 24 | 31 | | does not apply for renewal of that permit by the date specified by |
|---|
| 25 | 32 | | the commission under this section, the permit shall expire at the |
|---|
| 26 | 33 | | end of the period described in Subsection (a). |
|---|
| 27 | 34 | | SECTION 2. Section 382.0562(a), Health and Safety Code, is |
|---|
| 28 | 35 | | amended to read as follows: |
|---|
| 29 | 36 | | (a) The commission or its designee shall send notice of a |
|---|
| 30 | 37 | | proposed final action on a federal operating permit by first-class |
|---|
| 31 | 38 | | mail or electronic communication to the applicant and all persons |
|---|
| 32 | 39 | | who comment during the public comment period or at the public |
|---|
| 33 | 40 | | hearing. The notice shall include a response to any comment |
|---|
| 34 | 41 | | submitted during the public comment period and shall identify any |
|---|
| 35 | 42 | | change in the conditions of the draft permit and the reasons for the |
|---|
| 36 | 43 | | change. |

| 37 | 44 | | SECTION 3. This Act takes effect September 1, 2017. |
