44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the allocation of low income housing tax credits.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 2306.6710(b), Government Code, is
99 amended by adding section 2306.6710(b)(4) and (4-a) to read as
1010 follows:
1111 (4) the Department shall develop a scoring incentive for
1212 competitively awarded low income housing tax credits that includes,
1313 on an equal basis, points for either:
1414 (A) developments in primary attendance zones for
1515 elementary schools that have achieved combined ratings of B or
1616 better under the system administered by the Texas Education Agency;
1717 or
1818 (B) developments in market areas from which the
1919 development is projected to attract 51 percent or more of its
2020 tenants where those market areas encompass significant features
2121 that will:
2222 (i) promote household success;
2323 (ii) promote neighborhood pride and
2424 cohesiveness; and
2525 (iii) promote an affordable and healthy
2626 lifestyle for residents.
2727 (4-a) the features that will promote:
2828 (A) household success are:
2929 (i) established neighborhoods from which the
3030 proposed development is likely to draw a significant number of its
3131 tenants;
3232 (ii) neighborhoods that include places of
3333 worship, established civic organizations, established mentoring
3434 programs, or established parent teacher organizations whose
3535 established membership includes a significant proportion of person
3636 or households who would be income eligible for the proposed
3737 affordable housing; and
3838 (iii) neighborhoods that encompass mass transit
3939 stops that would enable residents of the proposed development to
4040 commute to areas of work opportunity;
4141 (B) neighborhood pride and cohesiveness include:
4242 (i) Designation of the neighborhood as an
4343 historical neighborhood;
4444 (ii) An active partnership between local law
4545 enforcement and neighborhood organizations to cooperate in
4646 addressing crime where that partnership has experienced
4747 demonstrable success in reducing crime and building positive
4848 relations between the community and law enforcement as acknowledged
4949 by the organization; and
5050 (iii) Activity during the prior year to
5151 remediate historic infrastructure issues such as inadequate street
5252 lighting; lack of sidewalks; installation of flood control
5353 measures; construction of new public facilities such as police
5454 stations, fire stations, indoor recreation facilities, transit
5555 stops for light rail;
5656 (C) an affordable and healthy lifestyle for residents
5757 include:
5858 (i) full service grocery stores;
5959 (ii) pharmacies;
6060 (iii) Public parks;
6161 (iv) Hospitals; and
6262 (v) Health clinics.
6363 SECTION 2. The change in law made by this Act applies only
6464 to an application for low income housing tax credits that is
6565 submitted to the Texas Department of Housing and Community Affairs
6666 during an application cycle that is based on the 2018 qualified
6767 allocation plan or a subsequent plan adopted by the governing board
6868 of the department under Section 2306.67022, Government Code. An
6969 application that is submitted during an application cycle that is
7070 based on an earlier qualified allocation plan is governed by the law
7171 in effect on the date the application cycle began, and the former
7272 law is continued in effect for that purpose.
7373 SECTION 5. This Act takes effect September 1, 2017.
