55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the acquisition or attempted acquisition of a firearm
88 by a person prohibited from possessing a firearm.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.06, Penal Code, is amended by
1111 amending Subsection (a) and adding Subsection (e) to read as
1212 follows:
1313 (a) A person commits an offense if the person:
1414 (1) sells, rents, leases, loans, or gives a handgun to
1515 any person knowing that the person to whom the handgun is to be
1616 delivered intends to use it unlawfully or in the commission of an
1717 unlawful act;
1818 (2) intentionally or knowingly sells, rents, leases,
1919 or gives or offers to sell, rent, lease, or give to any child
2020 younger than 18 years any firearm, club, or illegal knife;
2121 (3) intentionally, knowingly, or recklessly sells a
2222 firearm or ammunition for a firearm to any person who is
2323 intoxicated;
2424 (4) knowingly sells a firearm or ammunition for a
2525 firearm to any person who has been convicted of a felony before the
2626 fifth anniversary of the later of the following dates:
2727 (A) the person's release from confinement
2828 following conviction of the felony; or
2929 (B) the person's release from supervision under
3030 community supervision, parole, or mandatory supervision following
3131 conviction of the felony;
3232 (5) sells, rents, leases, loans, or gives a handgun to
3333 any person knowing that an active protective order is directed to
3434 the person to whom the handgun is to be delivered; [or]
3535 (6) knowingly purchases, rents, leases, or receives as
3636 a loan or gift from another a handgun while an active protective
3737 order is directed to the actor; or
3838 (7) knowingly acquires or attempts to acquire a
3939 firearm, while the actor is prohibited from possessing a firearm by
4040 state or federal law.
4141 (e) A licensed firearms dealer under the Brady Handgun
4242 Violence Prevention Act, 18 U.S.C. Section 922, who declines to
4343 transfer a firearm to a prospective transferee because the National
4444 Instant Criminal Background Check System indicates that the
4545 prospective transferee is prohibited from possessing a firearm
4646 shall notify the Department of Public Safety.
4747 SECTION 2. Subchapter D, Chapter 411, Government Code, is
4848 amended by adding Section 411.0525 to read as follows:
4949 Sec. 411.0525. INVESTIGATION OF LICENSED FIREARMS DEALER
5050 REPORT. (a) If the department receives a report under Section
5151 46.06(e), Penal Code, from a licensed firearms dealer under the
5252 Brady Handgun Violence Prevention Act, 18 U.S.C. Section 922, that
5353 a person prohibited from possessing a firearm has attempted to
5454 acquire a firearm, the department shall initiate an investigation.
5555 (b) If the department's investigation under this section
5656 produces evidence that a person may have violated Section 46.06,
5757 Penal Code, the department shall refer the case to the appropriate
5858 local authorities for further investigation and possible
5959 prosecution.
6060 SECTION 3. The change in law made by this Act applies only
6161 to an offense committed on or after the effective date of this Act.
6262 An offense committed before the effective date of this Act is
6363 governed by the law in effect on the date the offense was committed,
6464 and the former law is continued in effect for that purpose. For
6565 purposes of this section, an offense was committed before the
6666 effective date of this Act if any element of the offense occurred
6767 before that date.
6868 SECTION 4. This Act takes effect September 1, 2017.
