55 AN ACT
66 relating to the Comptroller's Property Value Study.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 403 of the Government Code is amended by
99 adding section 403.302(c-2) to read as follows:
1010 This subsection applies only to a school district with an
1111 enrollment of less than 2000 students located in a county
1212 contiguous to those counties with a population of more than
1313 1,000,000. If after conducting the study the comptroller determines
1414 that the local value for a school district is valid, the local value
1515 is presumed to represent taxable value for the school district. In
1616 the absence of that presumption, taxable value for a school
1717 district is calculated by multiplying the state value for the
1818 school district determined by the comptroller under Subsections (a)
1919 and (b) by 1.05, unless the local value exceeds the state value, in
2020 which case the taxable value for the school district is the
2121 district's local value. In determining whether the local value for
2222 a school district is valid, the comptroller shall use a margin of
2323 error that does not exceed five percent unless the comptroller
2424 determines that the size of the sample of properties necessary to
2525 make the determination makes the use of such a margin of error not
2626 feasible, in which case the comptroller may use a larger margin of
2727 error.
2828 SECTION 2. The changes in law made by this Act relating to
2929 the Comptroller's Property Value Study apply beginning with the tax
3030 year 2016 Property Value Study.
3131 SECTION 3. The changes in law made to Section 403.302(c-2),
3232 as amended by this Act, take effect immediately if this Act receives
3333 a vote of two-thirds of all members elected to each house as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for that section to have
3636 immediate effect, that section takes effect on the 91st day after
3737 the last day of the legislative session
