44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the renewal of the Texas Health Care Transformation and
77 Quality Improvement Program waiver under Medicaid.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 531, Government Code, is amended by
1010 adding Subchapter N-1 to read as follows:
1111 SUBCHAPTER N-1. TEXAS HEALTH CARE TRANSFORMATION AND QUALITY
1212 IMPROVEMENT PROGRAM WAIVER
1313 Sec. 531.521. RENEWAL REQUIREMENTS. Any renewal of the
1414 Texas Health Care Transformation and Quality Improvement Program
1515 waiver issued under Section 1115 of the federal Social Security Act
1616 (42 U.S.C. Section 1315) must:
1717 (1) allocate funding to hospitals and other safety net
1818 providers to ensure the financial viability of the hospitals and
1919 providers;
2020 (2) provide incentives for:
2121 (A) developing and expanding local and regional
2222 health care systems in order to reduce health care costs and
2323 increase the amount and types of health care services provided to
2424 uninsured persons; and
2525 (B) encouraging Medicaid recipients to actively
2626 participate in their health care and engage in healthy behaviors;
2727 (3) provide a continuum of health care services for
2828 Medicaid recipients that includes:
2929 (A) preventive care;
3030 (B) primary care;
3131 (C) specialty care;
3232 (D) outpatient services;
3333 (E) inpatient services;
3434 (F) mental health services; and
3535 (G) substance use services;
3636 (4) allow for variation in the manner Medicaid
3737 services are delivered, including through the use of:
3838 (A) managed care organizations;
3939 (B) accountable care organizations; or
4040 (C) health savings accounts; and
4141 (5) ensure that any additional federal matching funds
4242 available are accepted and used to provide local and regional
4343 health care services to otherwise uninsured persons.
4444 SECTION 2. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution.
4747 If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2017.
