7 | 7 | | Quality Improvement Program waiver under Medicaid. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Chapter 531, Government Code, is amended by |
---|
10 | 10 | | adding Subchapter N-1 to read as follows: |
---|
11 | 11 | | SUBCHAPTER N-1. TEXAS HEALTH CARE TRANSFORMATION AND QUALITY |
---|
12 | 12 | | IMPROVEMENT PROGRAM WAIVER |
---|
13 | 13 | | Sec. 531.521. RENEWAL REQUIREMENTS. Any renewal of the |
---|
14 | 14 | | Texas Health Care Transformation and Quality Improvement Program |
---|
15 | 15 | | waiver issued under Section 1115 of the federal Social Security Act |
---|
16 | 16 | | (42 U.S.C. Section 1315) must: |
---|
17 | 17 | | (1) allocate funding to hospitals and other safety net |
---|
18 | 18 | | providers to ensure the financial viability of the hospitals and |
---|
19 | 19 | | providers; |
---|
20 | 20 | | (2) provide incentives for: |
---|
21 | 21 | | (A) developing and expanding local and regional |
---|
22 | 22 | | health care systems in order to reduce health care costs and |
---|
23 | 23 | | increase the amount and types of health care services provided to |
---|
24 | 24 | | uninsured persons; and |
---|
25 | 25 | | (B) encouraging Medicaid recipients to actively |
---|
26 | 26 | | participate in their health care and engage in healthy behaviors; |
---|
27 | 27 | | (3) provide a continuum of health care services for |
---|
28 | 28 | | Medicaid recipients that includes: |
---|
29 | 29 | | (A) preventive care; |
---|
30 | 30 | | (B) primary care; |
---|
31 | 31 | | (C) specialty care; |
---|
32 | 32 | | (D) outpatient services; |
---|
33 | 33 | | (E) inpatient services; |
---|
34 | 34 | | (F) mental health services; and |
---|
35 | 35 | | (G) substance use services; |
---|
36 | 36 | | (4) allow for variation in the manner Medicaid |
---|
37 | 37 | | services are delivered, including through the use of: |
---|
38 | 38 | | (A) managed care organizations; |
---|
39 | 39 | | (B) accountable care organizations; or |
---|
40 | 40 | | (C) health savings accounts; and |
---|
41 | 41 | | (5) ensure that any additional federal matching funds |
---|
42 | 42 | | available are accepted and used to provide local and regional |
---|
43 | 43 | | health care services to otherwise uninsured persons. |
---|
44 | 44 | | SECTION 2. This Act takes effect immediately if it receives |
---|
45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 46 | | provided by Section 39, Article III, Texas Constitution. |

47 | 47 | | If this |
---|
48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
---|
49 | 49 | | Act takes effect September 1, 2017. |
