55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a memorandum of understanding between certain state
88 agencies related to training of employees and contractors who
99 provide certain services to children and families.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 533.0415(a), (d), and (e), Health and
1212 Safety Code, are amended to read as follows:
1313 (a) The executive commissioner, the Texas Juvenile Justice
1414 Department, and the Texas Education Agency by rule shall adopt a
1515 joint memorandum of understanding to develop interagency training
1616 for individuals employed or contracted by [the staffs of] the
1717 department, the Texas Juvenile Justice Department, the Department
1818 of Family and Protective Services, and the Texas Education Agency
1919 who are involved in the functions of assessment, case planning,
2020 case management, and in-home or direct delivery of services to
2121 children, youth, and their families under this title. The
2222 memorandum must:
2323 (1) outline the responsibility of each agency in
2424 coordinating, [and] developing, and implementing a plan for
2525 interagency training on effective [individualized] assessment,
2626 [and effective] intervention, and treatment services that are
2727 individualized and provided in the least restrictive environment
2828 appropriate for children and [dysfunctional] families; [and]
2929 (2) identify the available training programs
3030 administered by the state agencies identified by this subsection
3131 and the eligibility requirements for those programs; and
3232 (3) provide for the establishment of an interagency
3333 work group [task force] to identify:
3434 (A) common training needs for individuals
3535 employed or contracted by the state agencies identified by this
3636 subsection [develop a training program to include identified
3737 competencies, content, and hours for completion of the training
3838 with at least 20 hours of training required each year until the
3939 program is completed]; and
4040 (B) existing training and technical assistance
4141 resources, including web-based resources, available across the
4242 state agencies identified by this subsection that can be used to the
4343 greatest extent possible for the implementation of the plan
4444 described by Subdivision (1) [design a plan for implementing the
4545 program, including regional site selection, frequency of training,
4646 and selection of experienced clinical public and private
4747 professionals or consultants to lead the training; and
4848 [(C) monitor, evaluate, and revise the training
4949 program, including the development of additional curricula based on
5050 future training needs identified by staff and professionals].
5151 (d) The appropriate division of the commission designated
5252 by the commission shall act as the lead state agency in coordinating
5353 the development and implementation of the memorandum.
5454 (e) The executive commissioner and the state agencies
5555 identified by Subsection (a) shall review and by rule revise the
5656 memorandum not later than August of each odd-numbered year.
5757 SECTION 2. Sections 533.0415(b) and (c), Health and Safety
5858 Code, are repealed.
5959 SECTION 3. This Act takes effect September 1, 2017.
