| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. SUNSET ACT. Chapter 325, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 325.026 to read as follows: |
|---|
| 12 | 12 | | Sec. 325.026. GROUNDWATER CONSERVATION DISTRICTS SUBJECT |
|---|
| 13 | 13 | | TO REVIEW. (a) A groundwater conservation district listed in |
|---|
| 14 | 14 | | Subsection (b) is subject to a limited review under this chapter as |
|---|
| 15 | 15 | | if it were a state agency but may not be abolished. |
|---|
| 16 | 16 | | (b) This section applies to the: |
|---|
| 17 | 17 | | (1) Lone Star Groundwater Conservation District; and |
|---|
| 18 | 18 | | (2) Middle Pecos Groundwater Conservation District. |
|---|
| 19 | 19 | | (c) The limited review under this chapter must assess each |
|---|
| 20 | 20 | | groundwater conservation district's: |
|---|
| 21 | 21 | | (1) governance; |
|---|
| 22 | 22 | | (2) management; |
|---|
| 23 | 23 | | (3) operating structure; and |
|---|
| 24 | 24 | | (4) compliance with legislative requirements. |
|---|
| 25 | 25 | | (d) A groundwater conservation district reviewed by the |
|---|
| 26 | 26 | | commission under this section may not be required to conduct a |
|---|
| 27 | 27 | | management audit under Chapter 292, Title 30, Texas Administrative |
|---|
| 28 | 28 | | Code. |
|---|
| 29 | 29 | | SECTION 2. LONE STAR GROUNDWATER CONSERVATION DISTRICT. |
|---|
| 30 | 30 | | Chapter 1321 (H.B. 2362), Acts of the 77th Legislature, Regular |
|---|
| 31 | 31 | | Session, 2001, is amended by adding Section 1A to read as follows: |
|---|
| 32 | 32 | | Sec. 1A. (a) The district is subject to review under |
|---|
| 33 | 33 | | Chapter 325, Government Code (Texas Sunset Act), but may not be |
|---|
| 34 | 34 | | abolished under that chapter. The review shall be conducted under |
|---|
| 35 | 35 | | Section 325.026, Government Code, as if the district were a state |
|---|
| 36 | 36 | | agency scheduled to be abolished September 1, 2019, and every 12th |
|---|
| 37 | 37 | | year after that year. |
|---|
| 38 | 38 | | (b) The district shall pay the cost incurred by the Sunset |
|---|
| 39 | 39 | | Advisory Commission in performing the review. The Sunset Advisory |
|---|
| 40 | 40 | | Commission shall determine the cost, and the district shall pay the |
|---|
| 41 | 41 | | amount promptly on receipt of a statement from the Sunset Advisory |
|---|
| 42 | 42 | | Commission detailing the cost. |
|---|
| 43 | 43 | | SECTION 3. MIDDLE PECOS GROUNDWATER CONSERVATION DISTRICT. |

| 44 | 44 | | Subchapter A, Chapter 8851, Special District Local Laws Code, is |
|---|
| 45 | 45 | | amended by adding Section 8851.0015 to read as follows: |
|---|
| 46 | 46 | | Sec. 8851.0015. APPLICATION OF SUNSET ACT. (a) The |
|---|
| 47 | 47 | | district is subject to review under Chapter 325, Government Code |
|---|
| 48 | 48 | | (Texas Sunset Act), but may not be abolished under that chapter. |
|---|
| 49 | 49 | | The review shall be conducted under Section 325.026, Government |
|---|
| 50 | 50 | | Code, as if the district were a state agency scheduled to be |
|---|
| 51 | 51 | | abolished September 1, 2019, and every 12th year after that year. |
|---|
| 52 | 52 | | (b) The district shall pay the cost incurred by the Sunset |
|---|
| 53 | 53 | | Advisory Commission in performing the review. The Sunset Advisory |
|---|
| 54 | 54 | | Commission shall determine the cost, and the district shall pay the |
|---|

| 57 | 57 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 58 | 58 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 59 | 59 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 60 | 60 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 61 | 61 | | Act takes effect September 1, 2017. |
