77 relating to the abolition of the Office of State-Federal Relations.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 37.012(c), Education Code, is amended to
1010 read as follows:
1111 (c) The office of the governor [Office of State-Federal
1212 Relations] shall assist a local juvenile probation department in
1313 identifying additional state or federal funds to assist local
1414 juvenile probation departments conducting educational or job
1515 training programs within juvenile justice alternative education
1616 programs.
1717 SECTION 2. Section 421.021(a), Government Code, as amended
1818 by Chapters 93 (S.B. 686), 616 (S.B. 1393), and 1217 (S.B. 1536),
1919 Acts of the 83rd Legislature, Regular Session, 2013, is reenacted
2020 and amended to read as follows:
2121 (a) The Homeland Security Council is composed of the
2222 governor or the governor's designee, the speaker of the house of
2323 representatives or the speaker's designee, the lieutenant governor
2424 or the lieutenant governor's designee, and one representative of
2525 each of the following entities, appointed by the single statewide
2626 elected or appointed governing officer, administrative head, or
2727 chair, as appropriate, of the entity:

6262 SECTION 3. Section 493.013(b), Government Code, is amended
6363 to read as follows:
6464 (b) The board shall require the committee to:
6565 (1) maximize federal grant and entitlement funding
6666 available to the state;
6767 (2) submit biennially to the board a detailed report
6868 that includes information on all federal grants and entitlements
6969 identified and applied for by the committee and the results of the
7070 applications; and
7171 (3) work in conjunction with the governor's office and
7272 the Health and [Office of State-Federal Relations and the Texas
7373 Department of] Human Services Commission to investigate the
7474 applicability of:
7575 (A) the national school lunch program to inmates
7676 who are pursuing a primary or secondary education while confined in
7777 the institutional division; and
7878 (B) the food stamp program administered under
7979 Chapter 33, Human Resources Code, to inmates who are confined and
8080 treated in substance abuse felony punishment facilities.
8181 SECTION 4. Section 535.051(b), Government Code, is amended
8282 to read as follows:
8383 (b) The chief administrative officer of each of the
8484 following state agencies, in consultation with the governor, shall
8585 designate one employee from the agency to serve as a liaison for
8686 faith- and community-based organizations:
8787 (1) the Texas Commission on Environmental Quality;
8888 (2) the Texas Department of Criminal Justice;
8989 (3) the Texas Department of Housing and Community
9090 Affairs;
9191 (4) the Texas Juvenile Justice Department;
9292 (5) the Texas Veterans Commission;
9393 (6) the Texas Workforce Commission;
9494 (7) the office of the governor;
9595 (8) the Department of Public Safety;
9696 (9) the Texas Department of Insurance;
9797 (10) the Public Utility Commission of Texas;
9898 (11) the office of the attorney general;

106106 SECTION 5. Section 772.0101(a), Government Code, is amended
107107 to read as follows:
108108 (a) The border commerce coordinator shall establish and
109109 appoint the members of the Border Inspection, Trade, and
110110 Transportation Advisory Committee. The members must include
111111 representatives of the Texas Department of Transportation, the
112112 Department of Public Safety of the State of Texas, [the Office of
113113 State-Federal Relations,] the United States Department of
114114 Transportation, the Federal Motor Carrier Safety Administration,
115115 and other representatives of state and federal agencies involved in
116116 border crossing issues. Chapter 2110 does not apply to the size,
117117 composition, or duration of the Border Inspection, Trade, and
118118 Transportation Advisory Committee.
119119 SECTION 6. Section 772.011(b), Government Code, is amended
120120 to read as follows:
121121 (b) The work group is composed of the heads of the following
122122 agencies or their designees:
123123 (1) the Texas Department of Rural Affairs;
124124 (2) the Texas Department of Housing and Community
125125 Affairs;
126126 (3) the Texas Water Development Board;
127127 (4) the Texas Department of Transportation;
128128 (5) the Texas Commission on Environmental Quality;
129129 (6) the Texas Workforce Commission;
130130 (7) the Department of State Health Services;
131131 (8) the Health and Human Services Commission;
132132 (9) the General Land Office;
133133 (10) the Texas Economic Development and Tourism
134134 Office;
135135 (11) [the Office of State-Federal Relations;
136136 [(12)] the Texas Higher Education Coordinating Board;
137137 (12) [(13)] the attorney general's office;

141141 SECTION 7. Section 775.002(d), Government Code, is amended
142142 to read as follows:
143143 (d) The following agencies shall designate an officer or
144144 employee of the agency to serve as the agency's liaison for colonia
145145 initiatives:
146146 (1) the office of the attorney general;
147147 (2) the Department of State Health Services;
148148 (3) the Texas Department of Housing and Community
149149 Affairs;
150150 (4) the Texas Commission on Environmental Quality;
151151 (5) the Texas Water Development Board;
152152 (6) the Texas Department of Rural Affairs;
153153 (7) [the Office of State-Federal Relations;
154154 [(8)] the Texas Department of Insurance; and
155155 (8) [(9)] the Texas Department of Transportation.
156156 SECTION 8. Section 361.423(b), Health and Safety Code, is
157157 amended to read as follows:
158158 (b) The commission and the comptroller, on an ongoing basis,
159159 shall jointly:
160160 (1) identify existing economic and regulatory
161161 incentives and disincentives for creating an optimal market
162162 development strategy;
163163 (2) analyze or take into consideration the market
164164 development implications of:
165165 (A) the state's waste management policies and
166166 regulations;
167167 (B) existing and potential markets for plastic,
168168 glass, paper, lead-acid batteries, tires, compost, scrap gypsum,
169169 coal combustion by-products, and other recyclable materials; and
170170 (C) the state's tax structure and overall
171171 economic base;
172172 (3) examine and make policy recommendations regarding
173173 the need for changes in or the development of:
174174 (A) economic policies that affect
175175 transportation, such as those embodied in freight rate schedules;
176176 (B) tax incentives and disincentives;
177177 (C) the availability of financial capital
178178 including grants, loans, and venture capital;
179179 (D) enterprise zones;
180180 (E) managerial and technical assistance;
181181 (F) job-training programs;
182182 (G) strategies for matching market supply and
183183 market demand for recyclable materials, including intrastate and
184184 interstate coordination;
185185 (H) the state recycling goal;
186186 (I) public-private partnerships;
187187 (J) research and development;
188188 (K) government procurement policies;
189189 (L) educational programs for the public,
190190 corporate and regulated communities, and government entities; and
191191 (M) public health and safety regulatory
192192 policies;
193193 (4) establish a comprehensive statewide strategy to
194194 expand markets for recycled products in Texas;
195195 (5) provide information and technical assistance to
196196 small and disadvantaged businesses, business development centers,
197197 chambers of commerce, educational institutions, and nonprofit
198198 associations on market opportunities in the area of recycling; and
199199 (6) with the cooperation of the office of the governor
200200 [Office of State-Federal Relations], assist communities and
201201 private entities in identifying state and federal grants pertaining
202202 to recycling and solid waste management.
203203 SECTION 9. Section 132.001(d), Human Resources Code, is
204204 amended to read as follows:
205205 (d) The governor shall submit the agenda to the Texas
206206 congressional delegation [and to the Office of State-Federal
207207 Relations] and shall annually amend the agenda and rank agenda
208208 items. The agenda must identify issues of federal law, rules and
209209 regulations, or programs of common concern to different state
210210 agencies and programs.
211211 SECTION 10. Section 344.152(c), Local Government Code, is
212212 amended to read as follows:
213213 (c) The board may seek the assistance of the office of the
214214 governor [Office of State-Federal Relations] in identifying and
215215 applying for federal grants for fire control, prevention, and
216216 emergency medical services programs.
217217 SECTION 11. Section 363.152(c), Local Government Code, is
218218 amended to read as follows:
219219 (c) The board may seek the assistance of the office of the
220220 governor [Office of State-Federal Relations] in identifying and
221221 applying for federal grants for criminal justice programs. The
222222 board shall notify the appropriate council of government of any
223223 intent to submit applications for federal funds and for inclusion
224224 in the regional criminal justice planning process.
225225 SECTION 12. Section 201.053(b), Transportation Code, is
226226 amended to read as follows:
227227 (b) The chair shall:
228228 (1) preside over commission meetings, make rulings on
229229 motions and points of order, and determine the order of business;
230230 (2) represent the department in dealing with the
231231 governor;
232232 (3) report to the commission the governor's
233233 suggestions for department operations;
234234 (4) designate one or more employees of the department
235235 as a civil rights division of the department and receive regular
236236 reports from the division on the department's efforts to comply
237237 with civil rights legislation and administrative rules;
238238 (5) create subcommittees, appoint commissioners to
239239 subcommittees, and receive the reports of subcommittees to the
240240 commission as a whole;
241241 (6) appoint a commissioner to act in the chair's
242242 absence; and
243243 (7) serve as the departmental liaison with the
244244 governor [and the Office of State-Federal Relations] to maximize
245245 federal funding for transportation.
246246 SECTION 13. Section 1001.023(b), Transportation Code, is
247247 amended to read as follows:
248248 (b) The chair shall:
249249 (1) preside over board meetings, make rulings on
250250 motions and points of order, and determine the order of business;
251251 (2) represent the department in dealing with the
252252 governor;
253253 (3) report to the governor on the state of affairs of
254254 the department at least quarterly;
255255 (4) report to the board the governor's suggestions for
256256 department operations;
257257 (5) report to the governor on efforts, including
258258 legislative requirements, to maximize the efficiency of department
259259 operations through the use of private enterprise;
260260 (6) periodically review the department's
261261 organizational structure and submit recommendations for structural
262262 changes to the governor, the board, and the Legislative Budget
263263 Board;
264264 (7) designate at least one employee of the department
265265 as a civil rights officer of the department and receive regular
266266 reports from the officer or officers on the department's efforts to
267267 comply with civil rights legislation and administrative rules;
268268 (8) create subcommittees, appoint board members to
269269 subcommittees, and receive the reports of subcommittees to the
270270 board as a whole;
271271 (9) appoint a member of the board to act in the absence
272272 of the chair and vice chair; and
273273 (10) serve as the departmental liaison with the
274274 governor [and the Office of State-Federal Relations] to maximize
275275 federal funding for transportation.
276276 SECTION 14. Chapter 751, Government Code, is repealed.
277277 SECTION 15. On January 1, 2018:
278278 (1) the Office of State-Federal Relations is
279279 abolished;
280280 (2) all obligations, rights, contracts, records, real
281281 and personal property, funds, appropriations, and money of the
282282 Office of State-Federal Relations are transferred to the office of
283283 the governor;
284284 (3) the executive director of the Office of
285285 State-Federal Relations becomes an employee of the office of the
286286 governor;
287287 (4) an employee of the Office of State-Federal
288288 Relations becomes an employee of the office of the governor; and
289289 (5) a reference in other law to the Office of
290290 State-Federal Relations means the office of the governor.
291291 SECTION 16. This Act takes effect January 1, 2018.
