10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter A, Chapter 432, Government Code, is | |
12 | 12 | amended by adding Section 432.006 to read as follows: | |
13 | 13 | Sec. 432.006. PROSECUTION OF SEXUAL ASSAULT. (a) A | |
14 | 14 | criminal case alleging a sexual assault committed by a member of the | |
15 | 15 | state military forces must first be tried in an appropriate state | |
16 | 16 | court with jurisdiction over the case. | |
17 | 17 | (b) A military court may not try a person subject to this | |
18 | 18 | chapter for committing an offense described by Subsection (a) until | |
19 | 19 | any state prosecution of the offense is complete. | |
20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
24 | 24 | Act takes effect September 1, 2017. |
