66 AN ACT
77 relating to the jurisdiction of courts in criminal matters
88 involving allegations of sexual assault by a member of the state
99 military forces.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 432, Government Code, is
1212 amended by adding Section 432.006 to read as follows:
1313 Sec. 432.006. PROSECUTION OF SEXUAL ASSAULT. (a) A
1414 criminal case alleging a sexual assault committed by a member of the
1515 state military forces must first be tried in an appropriate state
1616 court with jurisdiction over the case.
1717 (b) A military court may not try a person subject to this
1818 chapter for committing an offense described by Subsection (a) until
1919 any state prosecution of the offense is complete.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2017.
