66 AN ACT
77 relating to constitutional allocations of money for emergency
88 medical services and trauma care systems.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 316.093, Government Code,
1111 is amended to read as follows:
1212 Sec. 316.093. ADJUSTMENT OF CONSTITUTIONAL ALLOCATIONS [TO
1313 FUND AND STATE HIGHWAY FUND].
1414 SECTION 2. Sections 316.093(b) and (c), Government Code,
1515 are amended to read as follows:
1616 (b) If the sum described by Subsection (a) is less than the
1717 sufficient balance adopted under Section 316.092, the comptroller
1818 shall reduce the allocations [allocation] to the state highway fund
1919 and to the account in the general revenue fund for emergency medical
2020 services and trauma care systems provided by Section 49-g(c),
2121 Article III, Texas Constitution, and increase the allocation to the
2222 economic stabilization fund, in an equal total amount, until the
2323 sufficient balance adopted under Section 316.092 is achieved.
2424 (c) If under Section 316.092 a sufficient balance has not
2525 been adopted for the comptroller to consider under this section,
2626 the comptroller shall adjust the allocation of amounts to be
2727 transferred to the fund, [and to] the state highway fund, and to the
2828 account in the general revenue fund for emergency medical services
2929 and trauma care systems provided by Section 49-g(c), Article III,
3030 Texas Constitution, so that the total of those amounts is
3131 transferred to the economic stabilization fund, except that the
3232 comptroller shall reduce a transfer made under this subsection as
3333 necessary to prevent the amount in the fund from exceeding the limit
3434 in effect for that biennium under Section 49-g(g) of that article.
3535 SECTION 3. Section 771.072(f), Health and Safety Code, is
3636 amended to read as follows:
3737 (f) The comptroller shall deposit the surcharges and any
3838 prior balances in accounts in the general revenue fund in the state
3939 treasury until they are allocated to regional planning commissions,
4040 other 9-1-1 jurisdictions, and regional poison control centers in
4141 accordance with this section. From those accounts, the amount
4242 necessary for the commission to fund approved plans of regional
4343 planning commissions and regional poison control centers and to
4444 carry out its duties under this chapter shall be appropriated to the
4545 commission. The account is composed of money deposited to the
4646 account under this subsection and one-half of the money allocated
4747 to an account in the general revenue fund for emergency medical
4848 services and trauma care systems under Section 49-g, Article III,
4949 Texas Constitution. Section 403.095, Government Code, does not
5050 apply to an account established by this subsection.
5151 SECTION 4. Section 773.006(b), Health and Safety Code, is
5252 amended to read as follows:
5353 (b) The account is composed of money deposited to the
5454 account under Article 102.0185, Code of Criminal Procedure, and
5555 one-half of the money allocated to an account in the general revenue
5656 fund for emergency medical services and trauma care systems under
5757 Section 49-g, Article III, Texas Constitution.
5858 SECTION 5. This Act takes effect on the date on which the
5959 constitutional amendment proposed by the 85th Legislature, Regular
6060 Session, 2017, providing for the use and dedication of certain
6161 money transferred to the general revenue fund account for emergency
6262 medical services and trauma care systems is approved by the voters.
6363 If that amendment is not approved by the voters, this Act has no
6464 effect.
