6	6	AN ACT
7	7	relating to constitutional allocations of money for emergency
8	8	medical services and trauma care systems.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. The heading to Section 316.093, Government Code,
11	11	is amended to read as follows:
12	12	Sec. 316.093. ADJUSTMENT OF CONSTITUTIONAL ALLOCATIONS [TO
13	13	FUND AND STATE HIGHWAY FUND].
14	14	SECTION 2. Sections 316.093(b) and (c), Government Code,
15	15	are amended to read as follows:
16	16	(b) If the sum described by Subsection (a) is less than the
17	17	sufficient balance adopted under Section 316.092, the comptroller
18	18	shall reduce the allocations [allocation] to the state highway fund
19	19	and to the account in the general revenue fund for emergency medical
20	20	services and trauma care systems provided by Section 49-g(c),
21	21	Article III, Texas Constitution, and increase the allocation to the
22	22	economic stabilization fund, in an equal total amount, until the
23	23	sufficient balance adopted under Section 316.092 is achieved.
24	24	(c) If under Section 316.092 a sufficient balance has not
25	25	been adopted for the comptroller to consider under this section,
26	26	the comptroller shall adjust the allocation of amounts to be
27	27	transferred to the fund, [and to] the state highway fund, and to the
28	28	account in the general revenue fund for emergency medical services
29	29	and trauma care systems provided by Section 49-g(c), Article III,
30	30	Texas Constitution, so that the total of those amounts is
31	31	transferred to the economic stabilization fund, except that the
32	32	comptroller shall reduce a transfer made under this subsection as
33	33	necessary to prevent the amount in the fund from exceeding the limit
34	34	in effect for that biennium under Section 49-g(g) of that article.
35	35	SECTION 3. Section 771.072(f), Health and Safety Code, is
36	36	amended to read as follows:
37	37	(f) The comptroller shall deposit the surcharges and any
38	38	prior balances in accounts in the general revenue fund in the state
39	39	treasury until they are allocated to regional planning commissions,
40	40	other 9-1-1 jurisdictions, and regional poison control centers in
41	41	accordance with this section. From those accounts, the amount
42	42	necessary for the commission to fund approved plans of regional
43	43	planning commissions and regional poison control centers and to
44	44	carry out its duties under this chapter shall be appropriated to the
45	45	commission. The account is composed of money deposited to the
46	46	account under this subsection and one-half of the money allocated
47	47	to an account in the general revenue fund for emergency medical
48	48	services and trauma care systems under Section 49-g, Article III,
49	49	Texas Constitution. Section 403.095, Government Code, does not
50	50	apply to an account established by this subsection.
51	51	SECTION 4. Section 773.006(b), Health and Safety Code, is
52	52	amended to read as follows:
53	53	(b) The account is composed of money deposited to the
54	54	account under Article 102.0185, Code of Criminal Procedure, and
55	55	one-half of the money allocated to an account in the general revenue
56	56	fund for emergency medical services and trauma care systems under
57	57	Section 49-g, Article III, Texas Constitution.
58	58	SECTION 5. This Act takes effect on the date on which the
59	59	constitutional amendment proposed by the 85th Legislature, Regular
60	60	Session, 2017, providing for the use and dedication of certain
61	61	money transferred to the general revenue fund account for emergency
62	62	medical services and trauma care systems is approved by the voters.
63	63	If that amendment is not approved by the voters, this Act has no
64	64	effect.
