| 7 | 7 | | relating to parental notification of class sizes at public schools |

| 8 | 8 | | in a district of innovation. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12A.003, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (d) to read as follows: |
|---|
| 12 | 12 | | (d) A local innovation plan that provides for the exemption |
|---|
| 13 | 13 | | of the district from the class size limits imposed by Section 25.112 |
|---|
| 14 | 14 | | must require the district to provide written notification of class |
|---|
| 15 | 15 | | size to each parent of or person standing in parental relation to a |
|---|
| 16 | 16 | | student enrolled in a class that exceeds the otherwise applicable |
|---|
| 17 | 17 | | limit. The notification must: |
|---|
| 18 | 18 | | (1) specify in conspicuous bold or underlined print |
|---|
| 19 | 19 | | the number of students in the class; |
|---|
| 20 | 20 | | (2) be provided not later than the 31st day after the |
|---|
| 21 | 21 | | first day of each school year during the term of the district's |
|---|
| 22 | 22 | | designation as a district of innovation; and |
|---|
| 23 | 23 | | (3) be included in a regular mailing or other |
|---|
| 24 | 24 | | communication from the campus or district, such as information sent |
|---|
| 25 | 25 | | home with students. |
|---|
| 26 | 26 | | SECTION 2. Section 12A.003(d), Education Code, as added by |
|---|
| 27 | 27 | | this Act, applies only to a local innovation plan adopted or renewed |
|---|
| 28 | 28 | | on or after the effective date of this Act. A local innovation plan |
|---|
| 29 | 29 | | adopted or renewed before the effective date of this Act is governed |
|---|
| 30 | 30 | | by the law in effect on the date the plan was adopted or renewed, and |
|---|
| 31 | 31 | | the former law is continued in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2017. |
