55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to parental notification of class sizes at public schools
88 in a district of innovation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12A.003, Education Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) A local innovation plan that provides for the exemption
1313 of the district from the class size limits imposed by Section 25.112
1414 must require the district to provide written notification of class
1515 size to each parent of or person standing in parental relation to a
1616 student enrolled in a class that exceeds the otherwise applicable
1717 limit. The notification must:
1818 (1) specify in conspicuous bold or underlined print
1919 the number of students in the class;
2020 (2) be provided not later than the 31st day after the
2121 first day of each school year during the term of the district's
2222 designation as a district of innovation; and
2323 (3) be included in a regular mailing or other
2424 communication from the campus or district, such as information sent
2525 home with students.
2626 SECTION 2. Section 12A.003(d), Education Code, as added by
2727 this Act, applies only to a local innovation plan adopted or renewed
2828 on or after the effective date of this Act. A local innovation plan
2929 adopted or renewed before the effective date of this Act is governed
3030 by the law in effect on the date the plan was adopted or renewed, and
3131 the former law is continued in effect for that purpose.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2017.
