8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 323, Business and Commerce Code, is | |
10 | 10 | amended by adding Section 323.004 to read as follows: | |
11 | 11 | Sec. 323.004. (a) Any online advertising platform which is | |
12 | 12 | used to advertise goods or services in Texas and which restricts | |
13 | 13 | access to sell goods or services on that platform shall provide a | |
14 | 14 | prominent online disclosure of such restrictions, including: | |
15 | 15 | (1) limitation on the types, quantities, or | |
16 | 16 | characteristics of goods permitted to be advertised on the online | |
17 | 17 | advertising platform; | |
18 | 18 | (2) limitation on the nature or characteristics of | |
19 | 19 | services permitted to be advertised on the online advertising | |
20 | 20 | platform; and | |
21 | 21 | (3) the fact, if true, that such goods or services are | |
22 | 22 | otherwise legal to offer or sell in Texas. | |

24 | 24 | A violation of (a) by the provider of an online | |
25 | 25 | advertising platform is a false, misleading, or deceptive act or | |
26 | 26 | practice subject to action by the consumer protection division | |
27 | 27 | under section 17.46(a). | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2017. |
