55 AN ACT
66 relating to the transparent disclosure of Internet advertising
77 practices.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 323, Business and Commerce Code, is
1010 amended by adding Section 323.004 to read as follows:
1111 Sec. 323.004. (a) Any online advertising platform which is
1212 used to advertise goods or services in Texas and which restricts
1313 access to sell goods or services on that platform shall provide a
1414 prominent online disclosure of such restrictions, including:
1515 (1) limitation on the types, quantities, or
1616 characteristics of goods permitted to be advertised on the online
1717 advertising platform;
1818 (2) limitation on the nature or characteristics of
1919 services permitted to be advertised on the online advertising
2020 platform; and
2121 (3) the fact, if true, that such goods or services are
2222 otherwise legal to offer or sell in Texas.
2323 (b)
2424 A violation of (a) by the provider of an online
2525 advertising platform is a false, misleading, or deceptive act or
2626 practice subject to action by the consumer protection division
2727 under section 17.46(a).
2828 SECTION 2. This Act takes effect September 1, 2017.
