55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a restriction on the expenditure of state money by a
88 state agency for the purpose of border security.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2113, Government Code, is amended by
1111 adding Subchapter F to read as follows:
1212 SUBCHAPTER F. RESTRICTIONS ON EXPENDITURES RELATED TO BORDER
1313 SECURITY IN CERTAIN AREAS OF STATE
1414 Sec. 2113.351. DEFINITIONS. In this subchapter:
1515 (1) "Border security" means activities associated
1616 with deterring crimes and enforcing state laws:
1717 (A) that relate to:
1818 (i) offenses listed in Section 772.0071; or
1919 (ii) federal law enforcement operations;
2020 and
2121 (B) for which this state receives federal grants
2222 intended to enhance law enforcement.
2323 (2) "Qualifying county" means a county that is:
2424 (A) adjacent to or within 20 miles of an
2525 international border;
2626 (B) adjacent to a county located on an
2727 international border; or
2828 (C) adjacent to the Gulf Intracoastal Waterway,
2929 as defined by Section 51.002, Transportation Code.
3030 Sec. 2113.352. RESTRICTION ON EXPENDITURES. A state agency
3131 may not use appropriated money for a purpose directly related to
3232 border security in a qualifying county unless the Legislative
3333 Budget Board certifies to the state agency that the state has
3434 received a commitment from the federal government to reimburse the
3535 state for the expenditure.
3636 SECTION 2. Section 2113.352, Government Code, as added by
3737 this Act, applies only to the use of appropriated money by a state
3838 agency on or after September 1, 2017.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2017.
