| 7 | 7 | | relating to a restriction on the expenditure of state money by a |
|---|
| 8 | 8 | | state agency for the purpose of border security. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 2113, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter F to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER F. RESTRICTIONS ON EXPENDITURES RELATED TO BORDER |
|---|
| 13 | 13 | | SECURITY IN CERTAIN AREAS OF STATE |
|---|
| 14 | 14 | | Sec. 2113.351. DEFINITIONS. In this subchapter: |
|---|
| 15 | 15 | | (1) "Border security" means activities associated |
|---|
| 16 | 16 | | with deterring crimes and enforcing state laws: |
|---|
| 17 | 17 | | (A) that relate to: |
|---|
| 18 | 18 | | (i) offenses listed in Section 772.0071; or |
|---|
| 19 | 19 | | (ii) federal law enforcement operations; |
|---|
| 20 | 20 | | and |
|---|
| 21 | 21 | | (B) for which this state receives federal grants |
|---|
| 22 | 22 | | intended to enhance law enforcement. |
|---|
| 23 | 23 | | (2) "Qualifying county" means a county that is: |
|---|
| 24 | 24 | | (A) adjacent to or within 20 miles of an |
|---|
| 25 | 25 | | international border; |
|---|
| 26 | 26 | | (B) adjacent to a county located on an |
|---|
| 27 | 27 | | international border; or |
|---|
| 28 | 28 | | (C) adjacent to the Gulf Intracoastal Waterway, |
|---|
| 29 | 29 | | as defined by Section 51.002, Transportation Code. |
|---|
| 30 | 30 | | Sec. 2113.352. RESTRICTION ON EXPENDITURES. A state agency |
|---|
| 31 | 31 | | may not use appropriated money for a purpose directly related to |
|---|
| 32 | 32 | | border security in a qualifying county unless the Legislative |
|---|
| 33 | 33 | | Budget Board certifies to the state agency that the state has |
|---|
| 34 | 34 | | received a commitment from the federal government to reimburse the |
|---|
| 35 | 35 | | state for the expenditure. |
|---|
| 36 | 36 | | SECTION 2. Section 2113.352, Government Code, as added by |
|---|
| 37 | 37 | | this Act, applies only to the use of appropriated money by a state |
|---|
| 38 | 38 | | agency on or after September 1, 2017. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2017. |
