10 | 18 | | Code, is amended by adding Chapter 3798 to read as follows: |

11 | 19 | | CHAPTER 3798. CELINA MUNICIPAL MANAGEMENT DISTRICT NO. 2 |

12 | 20 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
13 | 21 | | Sec. 3798.001. DEFINITIONS. In this chapter: |
---|
14 | 22 | | (1) "Board" means the district's board of directors. |
---|
15 | 23 | | (2) "City" means the City of Celina, Texas. |
---|
16 | 24 | | (3) "Commission" means the Texas Commission on |
---|
17 | 25 | | Environmental Quality. |
---|
18 | 26 | | (4) "Director" means a board member. |
---|
19 | 27 | | (5) "District" means the Celina Municipal Management |
---|
20 | 28 | | District No. 2. |
---|
21 | 29 | | Sec. 3798.002. CREATION AND NATURE OF DISTRICT. The |
---|
22 | 30 | | district is a special district created under Sections 52 and 52-a, |
---|
23 | 31 | | Article III, and Section 59, Article XVI, Texas Constitution. |
---|
24 | 32 | | Sec. 3798.003. PURPOSE; LEGISLATIVE FINDINGS. (a) The |
---|
25 | 33 | | creation of the district is essential to accomplish the purposes of |
---|
26 | 34 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
27 | 35 | | Texas Constitution, and other public purposes stated in this |
---|
28 | 36 | | chapter. By creating the district and in authorizing the city and |
---|
29 | 37 | | other political subdivisions to contract with the district, the |
---|
30 | 38 | | legislature has established a program to accomplish the public |
---|
31 | 39 | | purposes set out in Section 52-a, Article III, Texas Constitution. |
---|
32 | 40 | | (b) The creation of the district is necessary to promote, |
---|
33 | 41 | | develop, encourage, and maintain employment, commerce, |
---|
34 | 42 | | transportation, housing, tourism, recreation, the arts, |
---|
35 | 43 | | entertainment, economic development, safety, and the public |
---|
36 | 44 | | welfare in the district. |
---|
37 | 45 | | (c) This chapter and the creation of the district may not be |
---|
38 | 46 | | interpreted to relieve the city from providing the level of |
---|
39 | 47 | | services provided to the area in the district as of the effective |
---|
40 | 48 | | date of the Act enacting this chapter. The district is created to |
---|
41 | 49 | | supplement and not to supplant the city services provided in the |
---|
42 | 50 | | district. |
---|
43 | 51 | | Sec. 3798.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a) |
---|
44 | 52 | | The district is created to serve a public use and benefit. |
---|
45 | 53 | | (b) All land and other property included in the district |
---|
46 | 54 | | will benefit from the improvements and services to be provided by |
---|
47 | 55 | | the district under powers conferred by Sections 52 and 52-a, |
---|
48 | 56 | | Article III, and Section 59, Article XVI, Texas Constitution, and |
---|
49 | 57 | | other powers granted under this chapter. |
---|
50 | 58 | | (c) The district is created to accomplish the purposes of a |
---|
51 | 59 | | municipal management district as provided by general law and |
---|
52 | 60 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
53 | 61 | | Texas Constitution. |
---|
54 | 62 | | (d) The creation of the district is in the public interest |
---|
55 | 63 | | and is essential to: |
---|
56 | 64 | | (1) further the public purposes of developing and |
---|
57 | 65 | | diversifying the economy of the state; |
---|
58 | 66 | | (2) eliminate unemployment and underemployment; |
---|
59 | 67 | | (3) develop or expand transportation and commerce; and |
---|
60 | 68 | | (4) provide quality residential housing. |
---|
61 | 69 | | (e) The district will: |
---|
62 | 70 | | (1) promote the health, safety, and general welfare of |
---|
63 | 71 | | residents, employers, potential employees, employees, visitors, |
---|
64 | 72 | | and consumers in the district, and of the public; |
---|
65 | 73 | | (2) provide needed funding for the district to |
---|
66 | 74 | | preserve, maintain, and enhance the economic health and vitality of |
---|
67 | 75 | | the district territory as a community and business center; and |
---|
68 | 76 | | (3) promote the health, safety, welfare, and enjoyment |
---|
69 | 77 | | of the public by providing pedestrian ways and by landscaping and |
---|
70 | 78 | | developing certain areas in the district, which are necessary for |
---|
71 | 79 | | the restoration, preservation, and enhancement of scenic beauty. |
---|
72 | 80 | | (f) Pedestrian ways along or across a street, whether at |
---|
73 | 81 | | grade or above or below the surface, and street lighting, street |
---|
74 | 82 | | landscaping, parking, and street art objects are parts of and |
---|
75 | 83 | | necessary components of a street and are considered to be a street |
---|
76 | 84 | | or road improvement. |
---|
77 | 85 | | (g) The district will not act as the agent or |
---|
78 | 86 | | instrumentality of any private interest even though the district |
---|
79 | 87 | | will benefit many private interests as well as the public. |
---|
80 | 88 | | Sec. 3798.005. DISTRICT TERRITORY. (a) The district is |
---|
81 | 89 | | composed of the territory described by Section 2 of the Act enacting |
---|
82 | 90 | | this chapter, as that territory may have been modified under other |
---|
83 | 91 | | law. |
---|
84 | 92 | | (b) The boundaries and field notes contained in Section 2 of |
---|
85 | 93 | | the Act enacting this chapter form a closure. A mistake in the |
---|
86 | 94 | | field notes or in copying the field notes in the legislative process |
---|
87 | 95 | | does not affect the district's: |
---|
88 | 96 | | (1) organization, existence, or validity; |
---|
89 | 97 | | (2) right to contract; |
---|
90 | 98 | | (3) authority to borrow money or issue bonds or other |
---|
91 | 99 | | obligations described by Section 3798.251 or to pay the principal |
---|
92 | 100 | | and interest of the bonds or other obligations; |
---|
93 | 101 | | (4) right to impose or collect an assessment, or |
---|
94 | 102 | | collect other revenue; or |
---|
95 | 103 | | (5) legality or operation. |
---|
96 | 104 | | Sec. 3798.006. APPLICABILITY OF MUNICIPAL MANAGEMENT |
---|
97 | 105 | | DISTRICTS LAW. Except as otherwise provided by this chapter, |
---|
98 | 106 | | Chapter 375, Local Government Code, applies to the district. |
---|
99 | 107 | | Sec. 3798.007. CONSTRUCTION OF CHAPTER. This chapter shall |
---|
100 | 108 | | be liberally construed in conformity with the findings and purposes |
---|
101 | 109 | | stated in this chapter. |
---|
102 | 110 | | Sec. 3798.008. CONFLICTS OF LAW. This chapter prevails |
---|
103 | 111 | | over any provision of Chapter 375, Local Government Code, that is in |
---|
104 | 112 | | conflict or inconsistent with this chapter. |
---|
105 | 113 | | Sec. 3798.009. CONSENT OF MUNICIPALITY REQUIRED. The board |
---|
106 | 114 | | may not hold an election to authorize the issuance of bonds until |
---|
107 | 115 | | the governing body of the city by ordinance or resolution consents |
---|
108 | 116 | | to the creation of the district and to the inclusion of land in the |
---|
109 | 117 | | district. The city's consent must be granted in the manner provided |
---|
110 | 118 | | by Section 54.016, Water Code, for including land within the |
---|
111 | 119 | | corporate limits or extraterritorial jurisdiction of a city. |
---|
112 | 120 | | Sec. 3798.010. EFFECT OF ANNEXATION. Notwithstanding any |
---|
113 | 121 | | other law, if all or any part of the territory of the district is |
---|
114 | 122 | | annexed by the city into the city's corporate limits, the district |
---|
115 | 123 | | retains all of the district's outstanding debt and obligations and |
---|
116 | 124 | | continues to operate under this chapter until the district is |
---|
117 | 125 | | dissolved under Subchapter G. |
---|
118 | 126 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
119 | 127 | | Sec. 3798.051. GOVERNING BODY; TERMS. The district is |
---|
120 | 128 | | governed by a board of five directors who serve staggered terms of |
---|
121 | 129 | | four years, with two or three directors' terms expiring June 1 of |
---|
122 | 130 | | each even-numbered year. One director is appointed by the city, and |
---|
123 | 131 | | four directors are appointed by the commission as provided by |
---|
124 | 132 | | Sections 3798.052 and 3798.053, respectively. |
---|
125 | 133 | | Sec. 3798.052. APPOINTMENT AND REMOVAL OF DIRECTOR |
---|
126 | 134 | | APPOINTED BY CITY. (a) The governing body of the city shall |
---|
127 | 135 | | appoint one director who must be: |
---|
128 | 136 | | (1) at least 18 years of age; and |
---|
129 | 137 | | (2) a resident of the city. |
---|
130 | 138 | | (b) At any time the governing body of the city may remove the |
---|
131 | 139 | | director appointed by the city and appoint a director to serve the |
---|
132 | 140 | | remainder of the removed director's term. |
---|
133 | 141 | | Sec. 3798.053. APPOINTMENT BY COMMISSION. (a) Before the |
---|
134 | 142 | | term of a director other than a director appointed under Section |
---|
135 | 143 | | 3798.052 expires, the board shall recommend to the commission the |
---|
136 | 144 | | appropriate number of persons to serve as successor directors. The |
---|
137 | 145 | | commission shall appoint as directors the persons recommended by |
---|
138 | 146 | | the board. |
---|
139 | 147 | | (b) A person recommended by the board under Subsection (a) |
---|
140 | 148 | | must be: |
---|
141 | 149 | | (1) at least 18 years of age; |
---|
142 | 150 | | (2) an owner of property in the district; |
---|
143 | 151 | | (3) an owner of stock, whether beneficial or |
---|
144 | 152 | | otherwise, of a corporate owner of property in the district; |
---|
145 | 153 | | (4) an owner of a beneficial interest in a trust that |
---|
146 | 154 | | owns property in the district; or |
---|
147 | 155 | | (5) an agent, employee, or tenant of a person |
---|
148 | 156 | | described by Subdivision (2), (3), or (4). |
---|
149 | 157 | | Sec. 3798.054. VACANCY. If a vacancy occurs on the board, |
---|
150 | 158 | | the remaining directors shall appoint a director for the remainder |
---|
151 | 159 | | of the unexpired term. |
---|
152 | 160 | | Sec. 3798.055. DIRECTOR'S OATH OR AFFIRMATION. (a) A |
---|
153 | 161 | | director shall file the director's oath or affirmation of office |
---|
154 | 162 | | with the district, and the district shall retain the oath or |
---|
155 | 163 | | affirmation in the district records. |
---|
156 | 164 | | (b) A director shall file a copy of the director's oath or |
---|
157 | 165 | | affirmation with the secretary of the city. |
---|
158 | 166 | | Sec. 3798.056. OFFICERS. The board shall elect from among |
---|
159 | 167 | | the directors a chair, a vice chair, and a secretary. The offices |
---|
160 | 168 | | of chair and secretary may not be held by the same person. |
---|
161 | 169 | | Sec. 3798.057. COMPENSATION; EXPENSES. (a) The district |
---|
162 | 170 | | may compensate each director in an amount not to exceed $50 for each |
---|
163 | 171 | | board meeting. The total amount of compensation a director may |
---|
164 | 172 | | receive each year may not exceed $2,000. |
---|
165 | 173 | | (b) A director is entitled to reimbursement for necessary |
---|
166 | 174 | | and reasonable expenses incurred in carrying out the duties and |
---|
167 | 175 | | responsibilities of the board. |
---|
168 | 176 | | Sec. 3798.058. LIABILITY INSURANCE. The district may |
---|
169 | 177 | | obtain and pay for comprehensive general liability insurance |
---|
170 | 178 | | coverage from a commercial insurance company or other source that |
---|
171 | 179 | | protects and insures a director against personal liability and from |
---|
172 | 180 | | all claims relating to: |
---|
173 | 181 | | (1) actions taken by the director in the director's |
---|
174 | 182 | | capacity as a member of the board; |
---|
175 | 183 | | (2) actions and activities taken by the district; or |
---|
176 | 184 | | (3) the actions of others acting on behalf of the |
---|
177 | 185 | | district. |
---|
178 | 186 | | Sec. 3798.059. NO EXECUTIVE COMMITTEE. The board may not |
---|
179 | 187 | | create an executive committee to exercise the powers of the board. |
---|
180 | 188 | | Sec. 3798.060. BOARD MEETINGS. The board shall hold |
---|
181 | 189 | | meetings at a place that is accessible to the public and located in |
---|
182 | 190 | | the district or in the city. |
---|
183 | 191 | | Sec. 3798.061. INITIAL DIRECTORS. (a) On or after |
---|
184 | 192 | | September 1, 2017, the owner or owners of a majority of the assessed |
---|
185 | 193 | | value of the real property in the district according to the most |
---|
186 | 194 | | recent certified tax appraisal rolls for the county may submit a |
---|
187 | 195 | | petition to the commission requesting that the commission appoint |
---|
188 | 196 | | as initial directors the four persons named in the petition. The |
---|
189 | 197 | | commission shall appoint as initial directors the four persons |
---|
190 | 198 | | named in the petition. |
---|
191 | 199 | | (b) The governing body of the city shall appoint one initial |
---|
192 | 200 | | director. |
---|
193 | 201 | | (c) The initial directors shall determine by lot which three |
---|
194 | 202 | | positions expire June 1, 2019, and which two positions expire June |
---|
195 | 203 | | 1, 2021. |
---|
196 | 204 | | (d) This section expires September 1, 2019. |
---|
197 | 205 | | SUBCHAPTER C. POWERS AND DUTIES |
---|
198 | 206 | | Sec. 3798.101. GENERAL POWERS AND DUTIES. The district has |
---|
199 | 207 | | the powers and duties necessary to accomplish the purposes for |
---|
200 | 208 | | which the district is created. |
---|
201 | 209 | | Sec. 3798.102. IMPROVEMENT PROJECTS AND SERVICES. (a) |
---|
202 | 210 | | Subject to Subsection (b), the district may provide, design, |
---|
203 | 211 | | construct, acquire, improve, relocate, operate, maintain, or |
---|
204 | 212 | | finance an improvement project or service using money available to |
---|
205 | 213 | | the district, or contract with a governmental or private entity to |
---|
206 | 214 | | provide, design, construct, acquire, improve, relocate, operate, |
---|
207 | 215 | | maintain, or finance an improvement project or service authorized |
---|
208 | 216 | | under this chapter or Chapter 375, Local Government Code. |
---|
209 | 217 | | (b) The district may not construct or finance an improvement |
---|
210 | 218 | | project, other than a water, sewer, or drainage facility or road, |
---|
211 | 219 | | unless the governing body of the city by ordinance or resolution |
---|
212 | 220 | | consents to the construction or financing. |
---|
213 | 221 | | (c) The district may issue bonds, notes, or other |
---|
214 | 222 | | obligations to maintain or repair an existing improvement project |
---|
215 | 223 | | only if the governing body of the city by ordinance or resolution |
---|
216 | 224 | | consents to the issuance. |
---|
217 | 225 | | Sec. 3798.103. LOCATION OF IMPROVEMENT PROJECT. A district |
---|
218 | 226 | | improvement project may be located inside or outside of the |
---|
219 | 227 | | district. |
---|
220 | 228 | | Sec. 3798.104. OWNERSHIP OF IMPROVEMENT PROJECTS. (a) |
---|
221 | 229 | | Before a district improvement project may be put into operation, |
---|
222 | 230 | | the district must transfer ownership of the project to the city. |
---|
223 | 231 | | (b) The transfer of ownership is complete on the city's |
---|
224 | 232 | | acceptance of ownership. |
---|
225 | 233 | | Sec. 3798.105. RETAIL WATER AND SEWER SERVICES PROHIBITED. |
---|
226 | 234 | | The district may not provide retail water or sewer services. |
---|
227 | 235 | | Sec. 3798.106. ADDING OR REMOVING TERRITORY. (a) Subject |
---|
228 | 236 | | to Subsections (b), (c), and (d), the board may add or remove |
---|
229 | 237 | | territory as provided by Subchapter J, Chapter 49, Water Code. |
---|
230 | 238 | | (b) The district may add territory as described by |
---|
231 | 239 | | Subsection (a) only if the governing body of the city by ordinance |
---|
232 | 240 | | or resolution consents to the addition. |
---|
233 | 241 | | (c) The district and all districts created under Subchapter |
---|
234 | 242 | | D collectively may add a total area of not more than 100 acres. |
---|
235 | 243 | | (d) Territory added under Subsection (a) must be contiguous |
---|
236 | 244 | | to the district at the time of the addition. |
---|
237 | 245 | | Sec. 3798.107. NO EMINENT DOMAIN. The district may not |
---|
238 | 246 | | exercise the power of eminent domain. |
---|
239 | 247 | | SUBCHAPTER D. DIVISION OF DISTRICT INTO MULTIPLE DISTRICTS |
---|
240 | 248 | | Sec. 3798.151. DIVISION OF DISTRICT; PREREQUISITES. The |
---|
241 | 249 | | district, including territory added to the district under Section |
---|
242 | 250 | | 3798.106, may be divided into two or more new districts only if the |
---|
243 | 251 | | district has no outstanding bonded debt. Territory previously |
---|
244 | 252 | | added to the district under Section 3798.106 may be included in a |
---|
245 | 253 | | new district. |
---|
246 | 254 | | Sec. 3798.152. LAW APPLICABLE TO NEW DISTRICT. This |
---|
247 | 255 | | chapter applies to any new district created by division of the |
---|
248 | 256 | | district, and a new district has all the powers and duties of the |
---|
249 | 257 | | district. |
---|
250 | 258 | | Sec. 3798.153. DIVISION PROCEDURES. (a) The board, on its |
---|
251 | 259 | | own motion or on receipt of a petition signed by an owner of real |
---|
252 | 260 | | property in the district, may adopt an order proposing to divide the |
---|
253 | 261 | | district. |
---|
254 | 262 | | (b) If the board decides to divide the district, the board |
---|
255 | 263 | | shall: |
---|
256 | 264 | | (1) set the terms of the division, including names for |
---|
257 | 265 | | the new districts and a plan for the payment or performance of any |
---|
258 | 266 | | outstanding district obligations; |
---|
259 | 267 | | (2) prepare a metes and bounds description for each |
---|
260 | 268 | | proposed district; and |
---|
261 | 269 | | (3) appoint four initial directors for each new |
---|
262 | 270 | | district. |
---|
263 | 271 | | (c) The governing body of the city shall appoint one |
---|
264 | 272 | | director for each new district. |
---|
265 | 273 | | Sec. 3798.154. CONTRACT AUTHORITY OF NEW DISTRICTS. The |
---|
266 | 274 | | new districts may contract with each other for any matter the boards |
---|
267 | 275 | | of the new districts consider appropriate, including the joint |
---|
268 | 276 | | construction or financing of a utility improvement. |
---|
269 | 277 | | SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS; ASSESSMENTS |
---|
270 | 278 | | Sec. 3798.201. DISBURSEMENTS AND TRANSFERS OF MONEY. The |
---|
271 | 279 | | board by resolution shall establish the number of directors' |
---|
272 | 280 | | signatures and the procedure required for a disbursement or |
---|
273 | 281 | | transfer of the district's money. |
---|
274 | 282 | | Sec. 3798.202. MONEY USED FOR IMPROVEMENTS OR SERVICES. |
---|
275 | 283 | | The district may acquire, construct, or finance an improvement |
---|
276 | 284 | | project or service authorized by this chapter or Chapter 375, Local |
---|
277 | 285 | | Government Code, using any money available to the district. |
---|
278 | 286 | | Sec. 3798.203. METHOD OF NOTICE FOR HEARING. The district |
---|
279 | 287 | | may mail the notice required by Section 375.115(c), Local |
---|
280 | 288 | | Government Code, by certified or first class United States mail. |
---|
281 | 289 | | The board shall determine the method of notice. |
---|
282 | 290 | | Sec. 3798.204. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a) |
---|
283 | 291 | | The board by resolution may impose and collect an assessment for any |
---|
284 | 292 | | purpose authorized by this chapter in all or any part of the |
---|
285 | 293 | | district. |
---|
286 | 294 | | (b) An assessment, a reassessment, or an assessment |
---|
287 | 295 | | resulting from an addition to or correction of the assessment roll |
---|
288 | 296 | | by the district, penalties and interest on an assessment or |
---|
289 | 297 | | reassessment, an expense of collection, and reasonable attorney's |
---|
290 | 298 | | fees incurred by the district are: |
---|
291 | 299 | | (1) a first and prior lien against the property |
---|
292 | 300 | | assessed; |
---|
293 | 301 | | (2) superior to any other lien or claim other than a |
---|
294 | 302 | | lien or claim for county, school district, or municipal ad valorem |
---|
295 | 303 | | taxes; and |
---|
296 | 304 | | (3) the personal liability of and a charge against the |
---|
297 | 305 | | owners of the property even if the owners are not named in the |
---|
298 | 306 | | assessment proceedings. |
---|
299 | 307 | | (c) The lien is effective from the date of the board's |
---|
300 | 308 | | resolution imposing the assessment until the date the assessment is |
---|
301 | 309 | | paid. The board may enforce the lien in the same manner that the |
---|
302 | 310 | | board may enforce an ad valorem tax lien against real property. |
---|
303 | 311 | | (d) The board may make a correction to or deletion from the |
---|
304 | 312 | | assessment roll that does not increase the amount of assessment of |
---|
305 | 313 | | any parcel of land without providing notice and holding a hearing in |
---|
306 | 314 | | the manner required for additional assessments. |
---|
307 | 315 | | (e) The district may not impose an assessment on a |
---|
308 | 316 | | municipality, county, or other political subdivision. |
---|
309 | 317 | | Sec. 3798.205. NOTICE OF ASSESSMENTS. Annually, the board |
---|
310 | 318 | | shall file with the secretary of the city written notice that |
---|
311 | 319 | | specifies the assessments the district will impose in the |
---|
312 | 320 | | district's next fiscal year in sufficient clarity to describe the |
---|
313 | 321 | | assessments for the operation and maintenance of the district and |
---|
314 | 322 | | the assessments for the payment of debt service of obligations |
---|
315 | 323 | | issued or incurred by the district. |
---|
316 | 324 | | SUBCHAPTER F. TAXES AND BONDS |
---|
317 | 325 | | Sec. 3798.251. BONDS AND OTHER OBLIGATIONS. (a) The |
---|
318 | 326 | | district may issue, by public or private sale, bonds, notes, or |
---|
319 | 327 | | other obligations payable wholly or partly from ad valorem taxes or |
---|
320 | 328 | | assessments in the manner provided by Subchapter A, Chapter 372, or |
---|
321 | 329 | | Subchapter J, Chapter 375, Local Government Code. Sections |
---|
322 | 330 | | 375.207(a) and (b), Local Government Code, do not apply to the |
---|
323 | 331 | | district. |
---|
324 | 332 | | (b) In exercising the district's borrowing power, the |
---|
325 | 333 | | district may issue a bond or other obligation in the form of a bond, |
---|
326 | 334 | | note, certificate of participation or other instrument evidencing a |
---|
327 | 335 | | proportionate interest in payments to be made by the district, or |
---|
328 | 336 | | other type of obligation. |
---|
329 | 337 | | (c) In addition to the sources of money described by |
---|
330 | 338 | | Subchapter A, Chapter 372, and Subchapter J, Chapter 375, Local |
---|
331 | 339 | | Government Code, district bonds may be secured and made payable |
---|
332 | 340 | | wholly or partly by a pledge of any part of the money the district |
---|
333 | 341 | | receives from improvement revenue or from any other source. |
---|
334 | 342 | | (d) Not later than the 30th day before the date the district |
---|
335 | 343 | | holds a bond sale, the district shall provide the governing body of |
---|
336 | 344 | | the city written notice of the sale. |
---|
337 | 345 | | SUBCHAPTER G. DISSOLUTION |
---|

349 | 357 | | Sec. 3798.302. COLLECTION OF ASSESSMENTS AND OTHER REVENUE. |

350 | 358 | | (a) If the dissolved district has bonds or other obligations |

351 | 359 | | outstanding secured by and payable from assessments or other |
---|
352 | 360 | | revenue, other than revenue from ad valorem taxes, the city shall |

---|
354 | 362 | | enforcement and collection of the assessments or other revenue. |
---|
355 | 363 | | (b) The city shall have and exercise all district powers to |
---|
356 | 364 | | enforce and collect the assessments or other revenue to pay: |

357 | 365 | | (1) the bonds or other obligations when due and |
---|
358 | 366 | | payable according to their terms; or |
---|
359 | 367 | | (2) special revenue or assessment bonds or other |
---|
360 | 368 | | obligations issued by the city to refund the outstanding bonds or |
---|
361 | 369 | | obligations. |
---|
362 | 370 | | Sec. 3798.303. ASSUMPTION OF ASSETS AND LIABILITIES. (a) |

363 | 371 | | After the city dissolves the district, the city assumes, subject to |

364 | 372 | | the appropriation and availability of funds, the obligations of the |
---|
365 | 373 | | district, including any bonds or other debt payable from |
---|

369 | 377 | | SUBCHAPTER Z. SPECIAL BOND PROVISIONS |

370 | 378 | | Sec. 3798.901. APPLICABILITY. This subchapter applies only |

---|

376 | 384 | | Sec. 3798.903. WRITTEN AGREEMENT REGARDING SPECIAL |
---|
377 | 385 | | APPRAISALS. Before the district may issue bonds, the district and |

378 | 386 | | any person to whom the board intends that proceeds of the bonds be |
---|
379 | 387 | | distributed, including the developer, another owner of land in the |
---|
380 | 388 | | district, and any entity acting as a lender to the developer or |
---|
381 | 389 | | other landowner for the purpose of a project relating to the |
---|
382 | 390 | | district, must enter into a written agreement that: |
---|
383 | 391 | | (1) waives for the term of the agreement the right to a |
---|
384 | 392 | | special appraisal with respect to taxation by the district under |
---|
385 | 393 | | Subchapters B, C, D, E, F, and H, Chapter 23, Tax Code; and |
---|
386 | 394 | | (2) remains in effect for 30 years and is binding on |
---|
387 | 395 | | the parties, on entities related to or affiliated with the parties, |
---|
388 | 396 | | and on their successors and assignees. |
---|
389 | 397 | | Sec. 3798.904. REQUIREMENTS FOR ADVERTISING BOND ISSUE. A |
---|
390 | 398 | | district may not advertise for an issuance of bonds until the |
---|
391 | 399 | | completion of at least 25 percent of the projected value of the |
---|
392 | 400 | | improvements, including houses and other buildings, that are liable |
---|

---|
395 | 403 | | Sec. 3798.905. REQUIREMENTS FOR BOND ISSUE. The district |

396 | 404 | | may not issue bonds until: |

397 | 405 | | (1) the district submits to the commission: |

398 | 406 | | (A) an engineer's report describing the project |
---|
399 | 407 | | for which the bonds will provide funding, including data, profiles, |
---|
400 | 408 | | maps, plans, and specifications related to the project; and |
---|
401 | 409 | | (B) a cash flow analysis to determine the |
---|
402 | 410 | | projected rate of assessment, which includes the following |
---|
403 | 411 | | assumptions: |
---|
404 | 412 | | (i) each ending balance for debt service in |
---|
405 | 413 | | the analysis is not less than 25 percent of the following year's |
---|
406 | 414 | | debt service requirement; |
---|
407 | 415 | | (ii) interest income is only shown on the |
---|
408 | 416 | | ending balance for debt service for the first two years; and |
---|
409 | 417 | | (iii) the projected rate of assessment is |
---|
410 | 418 | | level or decreasing for the life of the bonds issued by the |
---|
411 | 419 | | district; |
---|
412 | 420 | | (2) the completion of at least 75 percent of the |
---|
413 | 421 | | projected value of the improvements, including houses and other |
---|
414 | 422 | | buildings, that are liable for district assessments and necessary |
---|
415 | 423 | | to support the district bonds; and |
---|
416 | 424 | | (3) the district has obtained an independent market |
---|
417 | 425 | | study from a firm recognized in the area of real estate market |
---|
418 | 426 | | analysis supporting the development projects for the real property |
---|
419 | 427 | | that is liable for district assessments and necessary to support |
---|
420 | 428 | | the district bonds. |
---|
421 | 429 | | Sec. 3798.906. REQUIREMENTS FOR COLLECTION OF REVENUE TO |
---|
422 | 430 | | PAY BONDS. The district may not collect an assessment to be used |
---|
423 | 431 | | for the payment of bonds until: |
---|
424 | 432 | | (1) the completion of at least 95 percent of the |
---|
425 | 433 | | underground water, wastewater, and drainage facilities financed |

426 | 434 | | from bond proceeds that are necessary to serve the projected |
---|
427 | 435 | | build-out, as certified by the district's engineer; |
---|
428 | 436 | | (2) the district or other appropriate party has |
---|
429 | 437 | | secured the groundwater, surface water, and water discharge permits |
---|
430 | 438 | | that are necessary to secure capacity to support the projected |
---|
431 | 439 | | build-out; |
---|
432 | 440 | | (3) the completion of at least 95 percent of lift |
---|
433 | 441 | | station, water plant, and sewage treatment plant capacity |
---|
434 | 442 | | sufficient to serve the connections constructed in the project for |
---|
435 | 443 | | a period of not less than 18 months, as certified by the district's |
---|
436 | 444 | | engineer; and |
---|
437 | 445 | | (4) the completion of at least 95 percent of the |
---|
438 | 446 | | streets and roads that are necessary to provide access to the areas |
---|
439 | 447 | | served by utilities and financed by the proceeds of bonds issued by |

441 | 449 | | constructed in accordance with municipal or county standards. |
